ENCROACHMENT AGREEMENT
This AMENDMENT TO CITY SECRETARY CONTRACT NO. 43613,
ENC ''_ OACHMENT AGREEMENT is made and entered into by and between the CITY OF
FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and
through its duly authorized Assistant City Manager or duly designated Director, hereinafter
referred to as the "City," and FIRST TEXAS HOMES, INC, acting herein by and through its
duly authorized representative hereinafter referred to as "Licensee".
RECITALS
WHEREAS, the City of Fort Worth ("City") and Grantee made and entered into City
Secretary Contract No. 43613 (the "Agreement") to authorize the use of a 15 foot permanent sewer
line easement for the construction of various improvements to be located at 9569 Chuparosa Drive,
Fort Worth, Texas 76177; and
WHEREAS, the Agreement contains a description of the improvement (various sized
waterlines and sidewalks) and exhibits that depict the construction of the improvements; and
WHEREAS, it advisable to execute this Amendment to the Agreement to revise the
Agreement to revise the exhibits of the improvements encroaching in to the permanent sewer line
easement to reflect that the improvements will include a six foot fabricated metal pool fence.
NOW THEREFORE, City and Licensee, acting herein by and through their duly
authorized representatives, enter into the following that amends the Agreement:
Section 1 is hereby amended to revise the exhibits of the improvements to include a six foot
fabricated metal pool fence as described in attached Exhibits A and B incorporated herein to the
Agreement.

in full force and effect.
