ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OP
FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and
through its duly authorized Assistant City Manager or duly designated Director, hereinafter
referred to as the "City," and AMPH]IJ3I[AN PRODUC FONS9 INC, acting herein by and
through its duly authorized representative hereinafter referred to as "Grantee".
RECITALS
WHEREAS, the City of Fort Worth ("City") and Grantee made and entered into. City
Secretary Contract No. 43614 (the "Agreement") to authorize the use of public right of way for the
construction of various improvements to be located at 120 South Main, Fort Worth, Texas 76104;
and
WHEREAS, EAS, the Agreement contains a list of the various improvements and exhibits that
depict the construction of the various improvements; and
WHEREAS, it advisable to execute this Amendment to the Agreement to revise the
Agreement to add sloped concrete at the front entry to facilitate handicapped access to the
description of improvements and exhibits of the improvements encroaching in to the public right of
way.
NOW THEREFORE, City and Grantee, acting herein by and through their duly authorized
representatives, enter into the following that amends the Agreement:
1.
Section 1 is hereby amended to add sloped concrete to facilitate handicapped access to the
list of improvements enumerated and hereby added to Exhibit A is Exhibit A.1 attached hereto and
incorporated herein to the Agreement.
