HomeMy WebLinkAboutContract 43725CITY SECRETARY � CONTRACT N00 FORT WORTH WATER DEPARTMENT PRETREATMENT SERVICES CONTRACT FOR MULTI -JURISDICTIONAL ENTITY WHEREAS, the City of Fort Worth and the City of North Richland Hills entered into a contract for the treatment of wastewater, such contract being City of Fort Worth City Secretary Contract No. 15715, dated May 8, 1987, as amended; and WHEREAS, the City of North Richland Hills is required by said contract to adopt and enforce an industrial pretreatment ordinance within its jurisdiction; and WHEREAS, the City of North Richland Hills has requested that the City of Fort Worth perform sampling of industrial wastes within the jurisdiction of the City of North Richland Hills, as well as performing the analysis of such samples; and WHEREAS, the City of Fort Worth is agreeable to performing the sampling and analysis on behalf of the City of North Richland Hills. NOW, THEREFORE, the City of Fort Worth, hereinafter referred to as "Fort Worth", and the City of North Richland Hills, hereinafter referred to as "North Richland Hills", hereby agree as follows: 1. Purpose The purpose of this agreement is for the City to provide wastewater quality monitoring, sampling and enforcement services required by it City Code of Ordinance Chapter 12.5, VI, state and federal laws and pursuant to the City Secretary Contract No. 15715 between Fort Worth and North Richland Hills, specifically but not limited to Articles 9 and 10 and Exhibit "A" to the Contract. 2. Significant Industrial Users North Richland Hills has identified the following as Significant Industrial Users (SIUs) within its jurisdiction as defined by Fort Worth's Code of Ordinances: • Fitz Manufacturing Industries located at 6625 Iron Horse Blvd., 76180. Bates Container, Inc. located at 6433 Davis Blvd., 76182. Tyson Food Service located at 6350 Browning Court, 76180. If North Richland Hills identifies additional SIUs located within its jurisdiction, North Richland Hills shall immediately notify Fort Worth in writing. This agreement shall be amended in writing to include such additional SIUs. 1 10-09-1 2 Al " :07 IN OFFICIAL RECORD CITY SECRETARY Ft WORTH, TX 3. Services Fort Worth agrees to perform the following services for North Richland Hills: a) Conduct an annual inspection of each SIU facility within the jurisdiction of North Richland Hills. b) Obtain a minimum of two (2) samples per year from each SIU for analysis and compliance with the Contract. Fort Worth shall conduct sampling and analysis in accordance with Exhibit "A" attached. c) Provide semi-annual reports forms to North Richland Hills to be conducted and returned to Fort Worth at the appropriate due date. d) Assist North Richland Hills with an annual survey and permitting of new SIUs within North Richland Hills's jurisdiction. e) Assist North Richland Hills in determining if new industries within North Richland Hills's jurisdiction are required to be permitted so as to be in compliance with the Contract. to pay: 4. Compensation In consideration of the services provided for by Fort Worth, North Richland Hills agrees a) A monthly fee as described in Exhibit "A"; and b) A monthly Customer Service Charge in the amount of $25.00. c) Anything beyond the scope of contract for sampling will be at cost per sample for listed parameters detailed on Exhibit "A". d) North Richland Hills shall be billed for services provided by Fort Worth related to pretreatment enforcement actions such as attendance and representation at show cause and/or administrative hearings or meetings. Such fee shall not to exceed $100.00 per employee per day such service is provided. North Richland Hills agrees to provide Fort Worth 96 hours advance written notice to appear and testify in enforcement actions. These charges shall be included in the monthly wastewater statement submitted to North Richland Hills pursuant to the Contract and shall be paid at the time such statement is due and payable. If the cost of these services listed in Section 4 shall exceed $50,000, Fort Worth shall provide advance written notice to North Richland Hills for written consent, in a mutually agreeable amount, which shall be incorporated in an amendment to the agreement. 2 5. Term and Renewal This agreement shall terminate on May 31, 2013, unless North Richland Hills requests a renewal for another year to Fort Worth at least thirty (30) days prior to the expiration date. Within fifteen (15) days after receipt of such notice Fort Worth shall advise North Richland Hills of any escalation in charges. Within three (3) business days, North Richland Hills shall confirm in writing that it agrees to the escalation in charges. 6. Nothing contained in this agreement shall be construed as amending, limiting or reducing North Richland Hills's obligations contained in the Contract. These costs are charged directly to the industries as a part of the monthly water bill. It includes sampling and analysis cost. Administration cost for inspection, permitting and sampling are also included in cost calculation. Sampling events are held at six-month intervals.
