ENCROACHMENT AGREEMENT
This AMENDMENT TO CITY SECRETARY CONTRACT NO.43965,
PROFESSIONAL SERVICE AGREEMENT is made and entered into by and between the
CITY OF FORT WORTH, a municipal corporation of Tarrant, Denton, and Wise Counties,
Texas, acting herein by and through its Fernando Costa, its duly authorized Assistant City
Manager, hereinafter referred to as the "City," and. CORBIN DESIGN, INC.,
("CONSULTANT"), a Michigan cooperation and acting by and through Shelley Steel, its duly
authorized vice-president.
RECITALS
WHEREAS, EREAS, the City of Fort Worth ("City") and CORBIN DESIGN, INC.,
("CONSULTANT"), made and entered into City Secretary Contract No. 43965 (the "Agreement")
on December 1, 2012; and
WHEREAS, the Agreement describes a scope of services for professional consulting
services for the purpose of wayfinding design, documentation and implementation; and
WHEREAS, the wayfinding project includes federal funding, which requires project review
and approval of funding by the Texas Department of Transportation (TxDOT) prior to
implementation and installation of the project; and
WHEREAS, due to TxDOT's scheduling of project start dates, the date for the wayfmding
project has been moved from December 2013 to May 2014 impacting the Consultant's ability to
meet the term expiration date in the Agreement; and
WHEREAS, staff recommends extending the term to expire on December 31, 2014 to
accommodate TxDOT's scheduling and allow the consultant to complete their scope of services.
NOW THEREFORE, City and CONSULTANT acting herein by and through their duly
authorized representatives enter into the following that amends the Agreement:
1.
Section 2. TERM is amended to read as follows:
This agreement shall commence upon December 1, 2012 ("Effective Date")
December 31, 2014, unless terminated earlier in accordance with the provis
