This First Renewal Agreement "Agreement" is made and entered into by and between the
City of Fort worth, Texas, a home rule municipal corporation situated in Tarrant, Denton, Parker,
and wise Counties, Texas "City" , acting by and through Fernando Costa, its duly authorized
Assistant City Manager, and Ace Pipe Cleaning, Inc, "Ace" acting by and through its duly
authorized representative. City and Ace may be referred to herein individually as a "Party'', or
collectively as the "Parties",

The following statements are true and correct and form the basis of this Agreement:
A. On April 13,2010,via M&C C-24175,City Council authorized a contract with Ace
for Citywide large diameter sever cleaning services, City Secretary Contract No. 40126 (the
"Contract").
B. The Contract contains three one-year renewal options under which the Contract may
he renewed under the same terms, conditions, and unit prices,
C. The City Council authorized execution of this Agreement via M&C C-25706 on July
1 , 2012.
Agreement
In consideration of the mutual covenants, premises and obligations contained herein, the
Parties agree as fellows:
1. The Contract is hereby renewed and extended for the first one-year renewal period under
the same terms, conditions, and unit prices, commencing on July 10, 2012.
2. M&C C-25706 reflects the appropriation of$308,000 for the services to be rendered
under this Agreement.
3. All ether terms and conditions of the Contract shall remain in full force and effect.

Pipe Clearing, Inc., in the Amount of$308,000.00 for the Interceptor Condition
Assessment Program Contract 2, Larger Diameter Sanitary Sewer Cleaning (ALL
COUNCIL DISTRICTS
RECOMMENDA T�oN:
It is recommended that the City Council authorize the execution of the first renewal to City Secretary
Contract No. 40126 with Ace Pipe Cleaning, Inc., in the amount of $308,000.00 for the Interceptor
Condition Assessment Program Contract 2, larger diameter sanitary sewer cleaning.
On April 13, 2010, (M&C C-24175) the City Council authorized a contract in the amount of
1 5,925.00 with Ace Pipe Cleaning, Inc., for Interceptor Condition Assessment Program Contract 2,
Larger Diameter Sanitary Sewer Cleaning. The contract contains three one year renewal options. The
purpose of this Mayor and Council Co mmunication is to exercise the first one year renewal option. All
terms, conditions, and unit prices contained in the contract remain in full force and effect.
The Interceptor Condition Assessment Program (ICAP) Contract 2, includes the cleaning of large
diameter sanitary sewers as identified by ICAP Contract 1.
ICAP Contract 2 - Lame Diameter Sanitary Sewer Cleaning is mandated by the Texas Commission
on Environmental Quality TCE , unitary Sewer Overflow Initiative SS I . In addition to being a
SS 01 regulatory requirement, the ICAP program is a major component of the Water Department's
Wastewater Master Plan to restore and maintain capacity within the wastewater collection system
and to facilitate short and long term CIP recommendation.
Ace Pipe Cleaning} Inc., is in compliance with the City's MBE Ordinance by committing to 1
percent / BE participation. The City's goal on this project is 18 percent.
This project is located citywide and affects ALL COUNCIL DISTRICTS.

The Financial Management Services Director certifies that funds are available In the current operating
budget, as appropriated, of the Water and Sewer Operating Fund.
