CITY OF FORT WORTH CONTRACT 53612
This Amendment is entered into by and between the City of Fort Worth (hereafter
"City"), a home rule municipality, with its principal place of business at 200 Texas Street, Fort
Worth, Texas, and Marjorie Lewis (hereafter"Author") a sole proprietor. City and Author shall
be referred to individually as a Party and collectively as the Parties.
WHEREAS, on March 4, 2020, the Parties entered into City Secretary Contract 53612
for Author to speak at the Tarrant County Bookfest, sign books, and participate in a question and
answer session("Agreement"); and
WHEREAS,the Agreement was scheduled on April 25, 2020, ("Performance Date);
WHEREAS,the Parties wish to amend the Agreement to change the Performance Date.
NOW, THEREFORE, the Parties, acting herein by the through their duly authorized
representatives, enter into the following agreement:

AMENDMENTS
Section I. TIME AND PLACE OF PERFORMANCE. Is hereby amended and replaced in
its entirety with the following:
1. The Author agrees to speak about her writing, sign books, and participate in a
question and answer session ("Performance") with the audience at 11 am on October 3,
2020, ("Performance Date") at Summerglen Library located at 4205 Basswood Blvd.,Fort
Worth, Texas ("Performance Site").
2. If the Performance is rescheduled, for any reason, the parties agree to execute an
amendment to this Agreement setting forth the rescheduled Performance date. If the
Author cannot perform on the rescheduled Performance Date,then the City may terminate
this Agreement without penalty. The City shall have sole discretion to determine the
rescheduled Performance Date.
Section 1II. AUTHOR'S OBLIGATIONS. Is hereby amended and replaced in its entirety
with the following:
1. Author agrees to arrive at the Event Site no later than 10:30 am on the Performance
Date. In the event that Author will not be able to arrive by 10:30 am on the Performance
Date, the Author agrees to contact Jennifer Demas at 682-287-4306 as soon as the Author
is aware of such delay. If the Author arrives after 10:30 am on the Performance Date and
the Performance cannot take place, as determined by City in its sole discretion,the Author
acknowledges and agrees that Author will not be paid for the Performance.
2. The Author agrees to speak about her writing, sign copies of her books or other

items if requested, and participate in a question and answer session with the audience at
the Performance.
3. The Author shall sign up as an official City vendor via the City of Fort Worth
website no later than September 25, 2020.
4. The Author shall provide all personnel necessary to facilitate the safe and enjoyable
participation by the public at the Performance.
Section VIII. TERM AND TERMINATION. Is hereby amended and replaced in its
entirety with the following:
1. This Agreement shall begin upon execution by both Parties and shall continue in
full force and effect until November 1, 2020, unless terminated earlier in accordance with
this Agreement.
2. This Agreement may be terminated by the City without cause with fourteen (14)
days written notice to the Author. This Agreement may also be terminated at any time by
the City for cause and upon notice to the Author.
3. If the City terminates this Agreement pursuant to section two of VIII, City shall not
owe any compensation to the Author.
4. If the City fails to provide at least fourteen(14)days'notice of cancellation,Author
shall be entitled to two hundred fifty dollars ($250) except in cases of Force Majeure, but
shall not be entitled to any additional compensation from City.

ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Agreement which are not expressly amended herein shall
remain in full force and effect.
3.
ELECTRONIC SIGNATURE
This Amendment may be executed in multiple counterparts, each of which shall be
an original and all of which shall constitute one and the same instrument.A facsimile copy
or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall
have the same effect as anoriginal.
