LJ1JIC i -rinle 1�3 The Texas Department of Housing and Community Affairs, a public and official agency of the State of Texas, and City of Fort Worth a political subdivision of the State of Texas agree to amend Contract no. 61130001571 executed by the Department on or about January 1, 2013 (herein the "Contract"). SECTION 2. DEPARTMENT OBLIGATIONS This Contract is amended by revising Section 4 A to read: A. In consideration of Subrecipient's full and satisfactory performance of this Contract, Department shall reimburse the actual allowable costs for administrative expenditures incurred by Subrecipient during the Contract Term and for the actual allowable costs for non -administrative expenditures incurred by Subrecipient on or after January 7, 2013 in an amount up to $1,477,768.00 in accordance with the budget as approved by the Department and the terms of this Contract. SECTION 3. RECORD KEEPING REQUIREMENTS This Contract is amended by revising Section 9 A to read: A. Subrecipient shall maintain fiscal and programmatic records and supporting documentation for all expenditures made under this Contract in accordance with the UGMS and Section III, Common Rule: State Uniform Administrative Requirements for Grants and Cooperative Agreements, Subpart C -Post Award Requirements, _.42. For purposes of compliance review, all associated documentation must be readily available, whether stored electronically or hard copy to justify compliance with program rules and regulations SECTION 4. The Parties hereto agree that all other terms of the Contract shall be and remain in full force and effect as therein set forth and shall continue to govem except to the extent that said terms conflict with the terms of this Amendment. In the event this Amendment and the terms of the Contract are in conflict, this Amendment shall govern, unless it would make the Contract void by law. SECTION 5. Each capitalized term not expressly defined herein shall have the meaning given to such term in the Contract. SECTION 6. Amendment may be executed in several counterparts, each of which shall be deemed to be an original copy, and all of which together shall constitute one agreement binding on Parties, notwithstanding that all the Parties shall not have signed the same counterpart. SECTION 7. If any of the Parties returns a copy by facsimile machine or electronic transmission, the signing party intends the copy of its authorized signature printed by the receiving machine or the electronic transmission to be its original signature. SECTION 8. By signing this Amendment, the Parties expressly understand and agree that its tens shall become a pad ntract as if it were set forth word for word therein. SECTION 9. Authorize the acceptance of a grant and the execution of an extension of contract with the Texas Department of Housing and Community Affairs in the amount up to $1,800,000 00 for the 2013 Community Services Block Grant program; 2. Authorize a non -interest bearing interfund loan from the fund balance of the General Fund to the Grants Fund in the amount of $300,000 00 for interim financing of this grant project pending contract xecution; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund in the amount of $1,800,000.00, and 4. Waive indirect costs. DISCUSSION: On December 13, 2013 the Texas Department of Housing and Community Affairs notified grantees that the City's grant award amount for the 2013 Community Services Block Grant (CSBG) program will be in the amount of $1,582,459 00 Staff projects there may be an increase in funding later during 2013 resulting in an estimated grant award in the amount of $1,800,000.00 for this program. At the time that the 2013 CSBG contracts are processed in January the Texas Department of Housing and Community Affairs will make 90 percent of the funds available. CSBG provides programs and services to assist low income persons with case management, emergency assistance, outreach and certification for energy assistance, information and referral and holiday assistance as well as services to provide clients with transportation to services for employment educational medical and other needs. The Community Action Partners in the Parks and Community Services Department serves as the designated Community Action Agency for all of Tarrant County in accordance with federal law and, as such, administers CSBG-funded programs. Ten neighborhood CAP offices will be utilized to deliver program services. Interim financing is necessary to provide transition from one grant funding period to the next. Re- lipayment to the General Fund will be made dunng the first reimbursements. No matching funds are required from the City for the CSBG program. A waiver by the City of indirect costs will maximize program benefits. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 20411-09-2012 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed.
