HomeMy WebLinkAboutContract 51093-A2 Date Received: Jul 14,2020 City Secretary Time Received: 07/15/20 Number: 51093-A2 SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO.51093 RIGHT OF WAY ENCROACHMENT AGREEMENT This SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 51093 ENCROACHMENT AGREEMENT is made and entered into by and between the CITY OF FORT WORTH, a municipal corporation of Tarrant County, Texas, acting herein by and through its duly authorized City Manager, its duly designated Assistant City Manager or Development Services Director, hereinafter referred to as the "City," and JS FW Hotel, LLC acting herein by and through its duly authorized representative,hereinafter referred to as "Licensee". RECITALS WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City Secretary Contract No. 51093 on August 8, 2018 (the "Agreement") to authorize the use of public right-of-way for the operation of a hotel downtown Fort Worth. In a perimeter area of 1,900 sq ft contains the following on a floor by floor basis: GROUND - Multiple door swings, Planters, Irrigation for planters, Surface grates for ventilation, Fencing/screening for outdoor dining, Pedestrian benches, Canopy/awning, Grease trap and appurtenances; LEVEL 2 - Banner sconce, Cornice,Attached signage, Banner signage; LEVEL 3 &4 - Second cornice;and WHEREAS, the City of Fort Worth ("City") and Licensee made and entered into City Secretary Contract No. 51093-CA1A1 on October 7, 2019 (the "First Amendment") to amend the Agreement to authorize additional use of public right-of-way to include the realignment of private sanitary sewer on 5 h Street; and WHEREAS, the parties wish to amend the Agreement to include two (2) blade signs and one(1) awning sign overhanging the City's Right-of-Way and one(1) large sculpture located within the City's Right-of-Way; and WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the Agreement to revise the exhibit in the Agreement to depict the additional encroachment area; NOW THEREFORE, City and Licensee, acting herein by and through their duly authorized representatives,enter into the following that amends the Agreement: Right of Way Amendment Oq*lA RECORD cm, ,Vr1 FTA17y FT WORTH, TX 1.
