PRETREATMENT SERVICES DIVISION CONTRACT FOR
MULTIJURISDICTIONAL ENTITY
WHEREAS, the City of Fort Worth and the City of Forest Hill entered into a contract
for the treatment of wastewater, such contract being City of Fort Worth City Secretary
Contract No. 15683, dated May 8,1987; and
WHEREAS, the City of Forest Hill is required by said contract to adopt and enforce an
industrial pretreatment ordinance within its jurisdiction; and
WHEREAS, the City of Forest Hill has requested that the City of Fort Worth perform
sampling of industrial wastes within the jurisdiction of the City of Forest Hill, as well as
performing the analysis of such samples; and
WHEREAS, the City of Fort Worth is agreeable to performing the sampling and analysis
on behalf of the City of Forest Hill.
NOW, THEREFORE, the City of Fort Worth, hereinafter referred to as "Fort Worth ", and
the City of Forest Hill, hereinafter referred to as "Forest Hill ", hereby agree as follows:

As of the date of this agreement, there is only one Significant Industrial User (SIU) within
the jurisdiction of Forest Hill, such SIU being Advanced Blending. At such time as the
number of SIUs increase, this agreement will be either amended to include the additional
SIUs or Fort Worth's obligations hereunder shall be limited to the existing SIU.

Fort Worth agrees to perform the following services which are related to Industrial
Connection and Monitoring, section 9 of Fort Worth City Secretary Contract No.
15683 (the "Contract "), for Forest Hill:
a) With Forest Hill representative(s), conduct an annual inspection of the SIU within the
jurisdiction of Forest Hill.
b) Obtain two (2) samples per year from the SIU for analysis and compliance with the
Contract. Sampling and analysis shall be in accord with Exhibit "A" attached.
c) Assist Forest Hill in conducting two (2) semi - annual reports of SIUs by providing forms
to Forest Hill to be forwarded to the SIU and for return to Fort Worth.
d) Assist Forest Hill with an annual survey and permitting of new SIUs within
Forest Hill's jurisdiction.

Forest Hill agrees to pay Fort Worth for the services required hereunder as follows:
a) The sum of $171.42 monthly for pretreatment services described under Section t�
b) A monthly Customer Service Charge in the amount of $25.00. -+--
c) These charges shall be included in the monthly wastewater statement submitted to
Forest Hill pursuant to the Contract and shall be paid at the time such

Excluded from the services to be provided under this contract are services related to
enforcement action taken by Forest Hill, together with any appeal there from by an
SIU. These services shall be considered to be additional services for which Fort Worth
shall be entitled to the following additional compensation.
a) Forest Hill agrees to pay Fort Worth an additional fee for services provided
to support and assist pretreatment related enforcement actions by Forest Hill
against noncompliant SIUs. A fee not to exceed $100.00 per day per Fort Worth
employee necessary to assist Forest Hill in enforcement action or
appeal from such enforcement action, including but not limited to,
attendance at show cause hearings, administrative hearings or hearings or
meetings involving enforcement actions.
b) Forest Hill agrees to provide Fort Worth written notice 96 hours in advance to appear and
testify in enforcement actions. In such event, travel and per diem expenses for such
personnel shall be paid by Forest Hill. Travel and per diem for court appearances shall be
based on current State laws.

This agreement shall terminate on May 31, 2013, unless renewed as herein after
specified. Forest Hill may renew this agreement on a yearly basis by giving Fort
Worth at least thirty (30) days prior written notice of its intent to renew. Within
fifteen (15) days after receipt of such notice Fort Worth shall advise Forest Hill of
any escalation in charges. Within three (3) business days, Forest Hill shall confirm in
writing that it agrees to the escalation in charges. Failure to so notify Fort Worth
shall render the agreement terminated at the end of the then current term.

Nothing contained in this agreement shall be construed as amending, limiting or
reducing Forest Hills obligations contained in the Contract.
