G� CONTRACT NO. 50758
This Fourth Amendment and Third Renewal to City Secretary Contract Number 50758
("Agreement") is by and between the City of Fort Worth ("City"), a home-rule municipality
organized under the laws of the State of Texas, acting by and through its duly authorized
Assistant City Manager, and Displays LLC, acting through Pamela Suggs, its Director of
Operations (the "Contractor"). The City has designated the Arts Council of Fort Worth and
Tarrant County, Inc. as its Contract Manager to manage this agreement on its behalf.
WHEREAS, on May 20, 2017, the City and Contractor entered into City Secretary
Contract Number 50758 (CSC No. 50758), whereby Contractor agreed to provide specific
services for the purpose of assisting with the care and maintenance of the Public Art Collection;
City and Contractor have also executed three amendments (CSC No. 50758 AIAD2, CSC No.
50758 A2AD6, and CSC No. 50758A3 ), two renewals (CSC No. 50758-R2 and 50758-R3) and
seven Addenda (CSC No. 50758-AD 1, CSC No. 50758-AlAD2, CSC No. 50758-AD3, CSC No.
50758-AD4, CSC No. 50758-AD5, CSC No. 50758-A2AD6, and CSC No. 50758-AD7
(collectively, the "Agreement"); and
WHEREAS, the Agreement sets forth that the Services to be provided shall be based on
an as-needed basis in accordance the Contractor's rate schedule; and
WHEREAS, the Agreement, with an original expiration date of June 1, 2018, provided
the City with the option of renewing and extending the Agreement for two additional one year
Renewal Terms; and
WHEREAS, the City and Contractor have executed two Renewal Terms and the
Agreement is now set to expire on June 1, 2020; and
WHEREAS, the Contractor has commenced work on two public art maintenance
projects that have been delayed due to COVID-19 restrictions and the City wishes to complete
the projects under the terms and conditions of the Agreement;
WHEREAS, the City and the Contractor now wish to amend the Agreement for a fourth
time to renew and extend the term of the Agreement through December 1, 2020;
NOW, THEREFORE, in consideration of the mutual covenants and agreements
hereinafter set forth, the sufficiency of which is hereby acknowledged, the parties agree as
follows:

I. AMENDMENT
The parties wish to amend Section 3.1 of the Agreement "Term," to allow for an
additional Renewal Term and to be and read as follows:
3.1 Term. This Agreement shall commence upon the Effective Date and shall expire on
the first day of the month next following one(1) year("Initial Term"). The City may, at its sole
discretion, opt to renew and extend this Agreement for three additional one year terms of up to
one year each("Renewal Terms"). Any Renewal Terms shall be duly executed in writing by the
parties.
II. RENEWAL
The parties hereby agree to renew and extend to the Agreement through December 1,
2020.
III.
All terms and conditions of the Agreement not specifically addressed herein remain in
full force and effect and are binding upon the parties.
