HomeMy WebLinkAboutContract 52783-A1 CSC No.52783-A1 AMENDMENT No.1 TO CITY SECRETARY CONTRACT No. 52783 WHEREAS, the City of Fort Worth (CITY) and Kimley-Horn and Associates, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 52783, (the CONTRACT) which was authorized by M&C 19-0024 on the 6th day of August, 2019 in the amount of $301, 890 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: Shoreview Culvert Improvements, Project No. 101820; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in a proposal dated July 16, 2020, a copy of which is attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $18, 000 . 00 . (See Attached Funding Breakdown Sheet, Page -4-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $319,890. 00. 3. All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. (KHA) is pleased to submit Amendment No. 1 in the amount of $18,000.The Amendment is for the following services: • Performing additional topographic survey for approximately four(4)cross sections of WF-11 creek upstream to Silver Creek Road needed to complete the hydraulic modeling for the culvert replacement. The effective model contains topographic data that is incorrect and appears to be approximately two feet in error from actual surveyed topography. The City of Fort Worth (City)and FEMA require a revised model to 'tie in'to an effective model within 0.5 feet. Currently, the model is tying in within two feet which is not acceptable. Obtaining this additional topographic data will allow the model to 'tie in'within the limits required by the City and FEMA. • Updating the HEC-RAS model for WF-11 creek to incorporate the new topographic information. This information is required in order to recreate the existing topographic data in the FEMA Effective Model to allow for the vertical 'tie in'that will meet City and FEMA requirements. • Updating the existing HMS model provided by the City to include the Lockheed Martin drainage area. This drainage area was not included in the effective model. Therefore, in order to model the watershed more accurately and size the culvert crossing appropriately, this effort is required. It is noted that at the time of the contract, it was not known that the surveyed topography would be two feet different than the LIDAR that we were instructed to use. In addition, the contract assumed the effective model would be accurate and no watershed updates were needed. The hydrologic model was inaccurate and did not include the Lockheed Martin drainage area. With Amendment 1, the revised contract amount will be$319,890.00.
