SECOND AMENDMENT TO THE NON-EXCLUSIVE MOWING AND GROUNDS
MAINTENANCE SERVICES AGREEMENT WITH NEW ERA CONTRACT SERVICES,LLC
(FORT WORTH CITY SECRETARY CONTRACT NO. 52310)
This Second Amendment to the Non-Exclusive Mowing and Grounds Maintenance Services
Agreement (the "Second Amendment") is made between the City of Fort Worth ("Fort Worth"), a
municipal corporation and New Era Contract Services,LLC,a Texas LLC("Contractor").
WHEREAS, City and Contractor entered into a Non-Exclusive Mowing Grounds Maintenance
Services Agreement, identified as Fort Worth City Secretary Contract No. 52310, (the "Agreement")
beginning May 8,2019 and expiring September 30,2019; and
WHEREAS,the Agreement was for the purpose of providing mowing and grounds maintenance
services of private properties within the City; and
WHEREAS, City and Contractor first renewed and amended the Agreement on September 19,
2020 to allow for the annual contract amount not to exceed$450,000.00; and
WHEREAS, the City and Contractor executed a second renewal on July 9, 2020 for a term
beginning on October 1,2020 and ending on September 30,2021.
WHEREAS, it is the collective desire of both City and Contractor to amend Exhibit B — Price
Schedule of the Agreement to reflect a change in price for each parcel or land property; and
NOW THEREFORE, known by all these present, City and Contractor, acting herein by the
through their duly authorized representatives,agree to the following terms,which amend the Agreement as
follows:
I.
AMENDMENT TO AGREEMENT
The following terms are hereby amended to either replace any conflicting terms in the Agreement or shall
be added to the terms and shall be binding and enforceable as if they were originally included therein and
the amended agreement shall be referred to as the Agreement in all future documents.
Exhibit B—Price Schedule shall be replaced in its entirety with the following:

Prices for each parcel or land property shall be calculated on the numbers set forth below:

ALL OTHER TERMS SHALL REMAIN THE SAME
All other terms, provisions, conditions, covenants and recitals of the Agreement not expressly amended
herein shall remain in full force and effect.
