CITY OF FORT WORTH
AMENDMENT 1 TO SECOND RENEWAL OF AGREEMENT
WHEREAS, the City of Fort Worth, ("City"), and William J. Schultz, Inc. dba
Circle C Construction Company,authorized to do business in Texas,("Contractor"), entered
into that certain AGREEMENT(City Secretary#47791,M&C C-27711) for the PROJECT
generally described as: Water & Sewer Main Replacements Contract 2015A, City Project
No.2738;and
WHEREAS, the AGREEMENT may be renewed up to two times as provided by
M&C C-27711;and
WHEREAS, The City and Contractor, effected the second renewal on August 12,
2019 ("Second Renewal") (CSC No. 47791-R2)with funding provided by M&C C-29156;
and
WHEREAS, The City has not had the need to fully engage Contractor under the
Second Renewal as demand for the services to be provided have slowed thus funding under
the Second Renewal remains;and
WHEREAS, The City and Contractor desire to amend the Second Renewal to
provide for an extended term,thus allowing the remaining funds to be expended.
NOW,THEREFORE,it is agreed by the City and Contractor as follows:
Article I
The Term of the Second Renewal shall be effective as of the effective date as stated
thereon and shall be for a duration commensurate with the expenditure of the funding,but in
no event shall the agreement last longer than five years from the.effective date.
EXECUTED by each party's duly authorized representative and EFFECTIVE as of
the date subscribed by the City's designated City Manager.
