AMENDMENT NO. 1 AND RENEWAL NO. 1
TO
INTERLOCAL AGREEMENT
FOR LIBRARY SERVICES
CITY OF FORT WORTH CONTRACT 47272
This Renewal and Amendment(the"Amendment")is made and entered into by and between
the City of Fort Worth (hereafter "City"), a home rule municipality, with its principal place of
business at 200 Texas Street, Fort Worth, Texas, and the City of Richland Hills ("MetrOPAC
Library"). City and MetrOPAC Library shall be referred to individually as a Party and collectively as
the Parties.
WHEREAS, the parties have previously entered into City of Fort Worth City Secretary
Contract No. 47272 (the "Agreement"); and
WHEREAS, City operates an Integrated Library System ("ILS") that uses advanced
technology specifically designed by an ILS vendor for the efficient circulation:cataloging: acquisition:
and processing of library materials,maintenance of customer accounts,and access to online databases
and other electronic materials; and
WHEREAS, the ILS is adaptable to provide similar services to other libraries in the vicinity
of the City: and
WHEREAS, the cities of Fort Worth, Benbrook, Burleson, Haltom City, Keller, Richland
Hills, and Watauga joined to create the MetrOPAC Library Consortium to receive automated library
system services from the City,provide reciprocal borrowing services for their residents, and negotiate
cooperative library material purchasing and licensing agreements: and
WHEREAS,the original term of the Agreement expires on November 30,2020; and
WHEREAS, the parties now wish to amend and renew the term of the Agreement for
continued services pursuant to the original Agreement until September 30,2021.
NOW, THEREFORE, City and MetrOPAC Library acting herein by their duly authorized
representatives,enter into the following agreement to amend and renew the contract:
1.
AMENDMENT TO AGREEMENT
The following terms are hereby amended to replace the referenced terms in the Agreement and
shall be binding and enforceable as if they were originally included therein.
3 TERM.
This Agreement shall begin on November 30, 2015 ("Effective Date") and shall expire on
September 30,2020("Expiration Date"),unless terminated earlier in accordance with this Agreement
("Initial Term"). Following the Initial Term, this Agreement may be renewed annually at the City's
discretion ("Renewal Term") for additional one-year renewal options to run from October 15t to
September 30''. The City will provide MetrOPAC Library with a renewal notice indicating its intent

to renew at least thirty (30) days prior to the end of each term. The City will provide MetrOPAC
Library with written notice of its intention not to renew at least thirty(30) days prior to the expiration
of the Initial Term or any Renewal Term. Failure to provide notice of non-renewal shall not bind the
City to an additional Renewal Term.
2.
RENEWAL OF AGREEMENT
The Agreement,as amended,is hereby renewed for an additional one-year term and will expire
September 30,2021,unless terminated earlier in accordance with the Agreement.
3.
ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Agreement which are not expressly amended herein shall remain in
full force and effect.
4.
ELECTRONIC SIGNATURE
This Amendment may be executed in multiple counterparts, each of which shall be an original
and all of which shall constitute one and the same instrument. A facsimile copy or computer image,
such as a PDF or tiff image, or a signature, shall be treated as and shall have the same effect as an
original.
