FIRST AMENDMENT
OF FORT WORTH CITY SECRETARY
CONTRACT NO. 54597
This First Amendment ("AMENDMENT") of Fort Worth City Secretary Contract
No.54597 ("AGREEMENT") is made and entered into by and between the City of Fort Worth,
a home-rule municipal corporation of the State of Texas ("City"), acting herein by and through
Fernando Costa, its duly authorized Assistant City Manager, and Fyoog, LLC ("Vendor"), a
Texas Limited Liability Company, acting herein by and through Dan Cheetham, its duly
authorized Principal. City and Vendor are individually referred to as a"Party" and collectively
referred to as the"Parties".
WHEREAS, City and Vendor were Parties to the Agreement for Vendor to provide to
City a Cost Estimate for the installation of an irrigation system and for fabricating,delivering,
and installing artwork at the Fort worth East Regional Library located at 6301 Bridge St.Fort
Worth,TX 76112(the"Site");
WHEREAS, the Agreement's initial term was originally to expire on September 30,
2020;
WHEREAS,prior to the expiration of the Agreement,the Parties both agreed to increase
the term of the Agreement to provide additional time to finish the services to be provided; and
WHEREAS,the Parties now mutually agree to memorialize the term extension by
amending the Agreement which will extend the term to December 31,2020.
NOW THEREFORE, KNOWN ALL BY THESE PRESENT, City and Vendor, acting
herein by and through their duly authorized representatives, enter into this Amendment, which
amends the Agreement as follows:
1.
The Agreement is hereby amended by replacing Section 2, "Term" of the Agreement in
its entirety and replacing it with the following:
2. Term. This Agreement shall begin on the date signed by the
Assistant City Manager below ("Effective Date") and shall expire on December
31, 2020 ("Expiration Date"), unless terminated earlier in accordance with this
Agreement.
2.
Except as expressly modified in this Amendment, all other terms and conditions of the
Agreement shall remain in full force and effect.
