On August 13, 2020 a final inspection was made on the subject project. There were punch list items
identified at that time. The punch list items were completed on August 17, 2020. The final inspection
and the corrected punch list items indicate that the work meets the City of Fort Worth specifications and
is therefore accepted by the City. The warranty period will start on August 17, 2020, which is the date of
the punch list completion and will extend of two (2)years in accordance with the Contract Documents.

I have applied corrections to their calculations as per our spec. See the comments in blue below.A
section with thickness below 3.4" is remove and replace or 0% payout (if accepted by the PM to
keep it in place). We can discuss this more during our meeting on Monday if we need to meet.The
contractor's approach is straight forward. I just added the 0% payout to his calculations.
Based off of the cores taken by the City of Fort Worth it was determined that 21 percent of the
asphalt placed was out of tolerance. Of the cores 4.2 percent was found to have a deductive payout
of 0%, 6.3 percent was found to have a deductive payout of 80%and the other 10.4 percent has a
deductive pay out of 90%. At this time Pavecon Public Works would prefer to not core anymore
locations due to creating possible future failures at each of the core locations. We believe the cores
provided, provide more than enough information to determine deductions.
The total square yards billed to date = 15,291.04(1 am assuming this is correct)
Total square yards to be paid at 0%= 637.13
Total square yards to be paid at 80%=955.69
Total square yards to be paid at 90%= 1,592.82
Unit price for Type B=$11.00—90% payout will be $9.90—80% payout will be $8.80

Contractor has been notified about core results and they proposed attached penalty based on core
results. I don't think their calculation is correct and that is why Edward was trying to come up with
some analysis.You are correct, if deficiency is less than 15% it needs to be replaced but I believe City
has the discretion. We may need to come to a resolution and notify contractor how we should
proceed on this.
For additional cores, do you know how many of them is required and how many feet apart?To
discuss further we may need to schedule a meeting.

Did anyone of you talk to the contractor if he accepts our core results?Or is he going to take
additional cores to isolate the deficient areas at his own expense?
Thickness deficiency more than 15% is remove and replace (not 20%).Also, we should determine the
penalty based on the core results, and I am not sure why we have scenarios here. IF the contractor is
taking additional cores, we wait until we get the additional core results to assess the penalty. If not,
we determine the penalty based on the core results we already have with no scenarios.
Let me know if the contractor is not taking additional cores, and we can discuss to assess the
penalty.

Please see attached Core Estimated penalty based on 400 feet 200'/200' scenario no. 1 if NO
additional cores are made. and an a scenario No.2 at 100 feet 50'/50' and the last scenario No.3 at
50 feet 25'/25'. The overall deficiency summation does not go below 80%which would require full
replacement of that section. Individually there are areas that of type D and type B, 2"+/-asphalt
each that fall less than 80%. But combined A& B is above the 80%. The core analysis and 80%
and 90%deficiency cost is calculated. In scenario No.1 Penalty of$26,266.67 is calculated if No
additional coring is done. Scenario No.2 calculate if additional coring is done at 100 feet 50'feet on
each side of deficient core approximately until deficiency is found. and similarly on scenario No.3 at
50 feet that being 25' on each side. Penalty reduction would be effective if additional cores are
taken.
I have attached a copy of the specification noting tables naming deficiency and penalty, the core
report of deficiency taken and Pavecon's proposed estimation of deficiency.
