HomeMy WebLinkAboutContract 48423-A3 CSC No.48423-A3 AMENDMENT No.3 i TO CITY SECRETARY CONTRACT WHEREAS, the City of Fort Worth (CITY) and CP&Y, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 48423 (the CONTRACT) which was authorized by M&C C-27985 on the 8th day of November 2016 in the j amount of $456,340. 00; and WHEREAS, the CONTRACT was subsequently revised by Amendment No. 1 in the amount of $13,098.36 administratively authorized July 3, 2017 and Amendment No. 2 in the amount of $168,985 . 00 which was authorized by M&C 20-0168 on April 7, 2020; and WHEREAS , the CONTRACT involves engineering services for the following project: Northeast Northside II 30-inch Water Transmission Main Along State Highway 170 from North Beach Street to US 377 . WHEREAS, it has become necessary to execute Amendment No.3 to the CONTRACT to include an increased scope of work and revised fee. i NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1. Article I of the CONTRACT is amended to include the additional engineering services specified in the proposal attached hereto and incorporated herein. The cost to City for the additional professional services to be performed by Engineer totals $99,815.00 (Water) . 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $738,238.36. 3. CP&Y is currently performing design services for these locations, however additional Professional Engineering Services are required based on coordination with the City of Fort Worth, TXDOT and their affiliates. CP&Y proposes to revise the scope of services based on the attached scope of additional services for the additional lump sum total of $99,815.00 for the additional design and construction services related to the relocation of the crossings at Beach,Westport, Beach, and Independence. Both the CITY and ENGINEER have attempted to clearly define the work to be performed and address the needs of the Project. Background As part of the TXDOT improvements along Highway 170, ENGINEER was tasked with the design the relocation of 4 crossing to an acceptable location and depth that is not in conflict with the TXDOT changes, as specified by TXDOT. The locations of the four(4) crossings to be relocated are approximately: • 913 LF of 30-inch Water Line (541 LF of 54-inch casing) crossing Highway 170 near Beach Street, • 510 LF of 30-inch Water Line(490 LF of 54-inch casing) crossing Highway 170 near Westport Parkway, • 860 LF 16-inch Water Line (440 LF of 30-inch casing) crossing Highway 170 near Independence Parkway, • 510 LF of 16-inch Water Line(490 LF of 30-inch casing) crossing Highway 170 near Alta Vista Drive An additional water line crossing of Highway 170 near Victory Lane will need a utility grade adjustments and extension of a concrete cap. Amendment 43 Changes Initial plans were to amend existing construction contracts with the new crossings to accelerate the schedule. Based on the complexity of the design and cost of the construction, it was decided to advertise these project traditionally. In addition, based on discussions with the City of Fort Worth, TXDOT and their constituents, additions and changes were made to the design of these segments from the previous agreement including • Lowering/relocating/modifications to the design of the pipelines, and modification to tunnel and blow-off valves based on updated design information, Clty of Fort Worth,Texas Attachment A PMO Release Date:07.23.2012 Page 1 of 3 ATTACHMENTA DESIGN SERVICES FOR SANITARY SEWER REHABILIATION CITY PROJECT NO.:102 Field services modified to modify Geotechnical services, remove Land Acquisition services, and add additional survey and SUE to Engineers scope of services. • Additional coordination services with TXDOT and their constituents, as well as extended contract time for design and construction. ® Development and Bidding of 2 Bid packages including development of additional specification sections and design sheets. Bidding of 2 Bid packages including development of additional specification sections and design sheets. Expanded Construction Services. This amendment modifies the previous amendment based on the revised scope items. SCOPE ENGINEER will evaluate the existing locations and provide recommendation on the revised relocation based on roadway plans provided by Others. Design will include the crossing of the roadway improvements and re-connection to the existing pipeline, ENGINEER will perform Geotechnical borings, laboratory tests, and engineering analysis for evaluation of the trenchless crossing of Highway 170 at three locations (Westport, Alta Vista, Independence) including 2 boring at each location, 6 borings total. In additional ENGINEER will be provided the field and laboratory tests, and related engineering analysis, determination of soil conditions, and geotechnical recommendations for trenchless pipe installation. Geotechnical evaluation at Beach Street to be performed by others. ENGINEER will evaluate the depth of crossing for the new pipelines at all 4 locations (Beach, Westport, Alta Vista, and Independence), based on geotechnical data performed as a part of contract and depth of proposed highway. ENGINEER will provide a design for the crossing of Highway 170 that meets TXDOT and Fort Worth requirements. ENGINEER will provide a 90% and 100%set of plans for City of Fort Worth review per Task 4 of the original contract. ENGINEER will not provide a Preliminary Design (30%) or 60% Design review submittal, per Task 3 and Task 4 of the original contract. ENGINEER will prepare complete plans and specifications for this project in 2 separate packages,to be bid at 2 separate times. One bid package will include Beach Street, and the other bid package will include the other three (3) crossings and Victory Lane. ENGINEER will perform bid phase services for the 2 bid packages, ENGINEER to perform Level "A" and "B"SUE at the bore pit locations at Westport, Alta Vista, Independence. Utilities to be designated include gas, telecommunications, electric, traffic signals, storm, water and sanitary sewer. ENGINEER will be provided survey data from a 3rd party that documents all above ground features in the area. The survey data will be sufficient to meet the requirements of Section 8.1 of the original contract. In areas where the design extends outside of the previously defined TXDOT corridor, ENGINEER will be responsible for obtaining the additional survey. Westport, Alta Vista, Independence City of Fort Worth,Texas Attachment A PMO Release Date:08.1.2014 Page 2 of 3 ATTACHMENT A DESIGN SERVICES FOR SANITARY SEWER REHABILIATION CITY PROJECT NO.:102 ENGINEER will assist in the evaluation of shop submittal, RFI, change order during construction, and site visits as directed by City of Fort Worth, ENGINEER will provide record drawings for the project at the conclusion of construction. ASSUMPTIONS • ENGINEER will not submit monthly progress reports on the status of the project. • ENGINEER will use City of Fort Worth standard specifications for the project and supplement as needed. • ENGINEER will not provide a Preliminary Design Report, 30% or 60% progress drawings as part of this project. • City of Fort Worth will primarily perform engineering service during construction including shop submittal, RFI, change order, and pay applications. ENGINEER will assist as needed based on the limited scope and budget developed. • ENGINEER was provided with CAD files in Microstation format from a 3rd party showing the extents of existing conditions and the proposed conditions for the TXDOT redesign of Highway 170. This will include the existing and proposed ROW for TXDOT and adjacent utilities,existing and proposed Highway layouts, as well as vertical and horizontal location of known utilities within the pipeline design area. • Easement documents to be used to obtain permanent and temporary easements required to construct the pipeline improvements at the four(4) relocations will be performed by others under separate contract. The City of Fort Worth will be responsible for real property acquisition. • SUE at Beach Street crossing will be performed by Contractor per the construction agreement. No SUE at Beach Street to be performed by ENGINEER. Geotechnical borings, laboratory tests, and engineering analysis for evaluation of the trenchless crossing of Highway 170 at Beach Street to be performed by others under separate contract. Engineer will be provided including 2 boring at each location, 6 borings total.
