This Agreement is made and entered into this day of July 2009, by and between the COUNTY of TARRANT, acting by and through its duly authorized representative, hereinafter referred to as COUNTY, the CITY of FORT WORTH, acting by and through its duly authorized representative, hereinafter referred to as CITY, and the Cities of Arlington, Azle, Bedford, Benbrook, Crowley, Euless, Everman, Forest Hill, Grapevine, Haltom City, Hurst, Keller, Kennedale, Lake Worth, Mansfield, North Richland Hills, Richland Hills, Saginaw, White Settlement and Watauga acting by and through their duly authorized representatives, and hereinafter referred to as SUBRECIPIENT(S), located entirely within the State of Texas,witnesseth: WHEREAS, this Agreement is made under the authority of Section 791.011 of the Texas Government Code; and WHEREAS, each governing body, in performing governmental functions or in paying for the performance of governmental functions hereunder, shall make that performance or those payments from current revenues legally available to that party; and WHEREAS, each governing body finds that the performance of this Agreement is in the best interests of all parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement; and WHEREAS, under the Recovery Act Byrne Justice Assistance Grant (JAG), the Department of Justice (DOJ) has awarded a total of $4,140,165.00 to be distributed to the parties to this Agreement; and WHEREAS, the CITY has agreed to serve as the fiscal agent for the Recovery Act: BYRNE JUSTICE ASSISTANCE GRANT (JAG), and distribute all such funds between the cooperating parties; and WHEREAS,the CITY agrees to provide the COUNTY$328,207 from its portion of the JAG award; SUBRECIPIENT ARLINGTON agrees to provide the COUNTY$200,037 from its portion of the JAG award; SUBRECIPIENT AZLE agrees to provide the COUNTY$2,707 from its portion of the JAG award; SUBRECIPIENT BEDFORD agrees to provide the COUNTY $19,600 from its portion of the JAG award; SUBRECIPIENT BENBROOK agrees to provide the COUNTY $2,473 from its portion of the JAG award; SUBRECIPIENT CROWLEY agrees to provide the COUNTY $2,030 from its portion of the JAG award; SUBRECIPIENT EULESS agrees to provide the COUNTY$9,891 from its portion of the JAG award; Memorandum of Understanding between the Cities of Arlington,Azle,Bedford,Benbrook,Cro Iey,`Euless;-- .- Everman,Forest Hill,Fort Worth,Grapevine,Haltom City,Hurst,Keller,Kennedale,Lake Wor ,Mansfield North Richland Hills,Richland Hills,Saginaw,White Settlement and Watauga,and the County f'Sa rant$AAL RECORD Texas " �,.{�y SECRETARY 1 of 25 FT- WORTH, TX SUBRECIPIENT EVERMAN agrees to provide the COUNTY $2,056 from its portion of the JAG award; SUBRECIPIENT FOREST HILL agrees to provide the COUNTY $6,768 from its portion of the JAG award; SUBRECIPIENT GRAPEVINE agrees to provide the COUNTY $7,054 from its portion of the JAG award; SUBRECIPIENT HALTOM CITY agrees to provide the COUNTY$13,223 from its portion of the JAG award; SUBRECIPIENT HURST agrees to provide the COUNTY$14,993 from its portion of the JAG award; SUBRECIPIENT KELLER agrees to provide the COUNTY$2,082 from its portion of the JAG award; SUBRECIPIENT KENNEDALE agrees to provide the COUNTY $3,045 from its portion of the JAG award; SUBRECIPIENT LAKE WORTH agrees to provide the COUNTY $3,540 from its portion of the JAG award; SUBRECIPIENT MANSFIELD agrees to provide the COUNTY $7,314 from its portion of the JAG award; SUBRECIPIENT NORTH RICHLAND HILLS agrees to provide the COUNTY $15,930 from its portion of the JAG award; SUBRECIPIENT RICHLAND HILLS agrees to provide the COUNTY $1,718 from its portion of the JAG award; SUBRECIPIENT SAGINAW agrees to provide the COUNTY $2,759 from its portion of the JAG award; SUBRECIPIENT WATAUGA agrees to provide the COUNTY $4,607 from its portion of the JAG award; and SUBRECIPIENT WHITE SETTLEMENT agrees to provide the COUNTY $3,592 from its portion of the JAG award. WHEREAS,the CITY,SUBRECIPIENTS and COUNTY believe it to be in their best interests to reallocate the JAG funds as set forth herein. NOW THEREFORE,the COUNTY and CITY, and SUBRECIPIENTS agree as follows: Section 1. CITY agrees to reimburse the COUNTY a total of$708,613 of JAG funds; CITY agrees to reimburse SUBRECIPIENT ARLINGTON a total of$1,050,196 of JAG funds; CITY agrees to reimburse SUBRECIPIENT AZLE a total of$14,212 of JAG funds; CITY agrees to reimburse SUBRECIPIENT BEDFORD a total of$102,902 of JAG funds; CITY agrees to reimburse SUBRECIPIENT BENBROOK a total of$12,982 of JAG funds; CITY agrees to reimburse SUBRECIPIENT CROWLEY a total of$10,659 of JAG funds; CITY agrees to reimburse SUBRECIPIENT EULESS a total of$51,929 of JAG funds; CITY agrees to reimburse SUBRECIPIENT EVERMAN a total of$10,796 of JAG funds; CITY agrees to reimburse SUBRECIPIENT FOREST HILL a total of$35,530 of JAG funds; CITY agrees to reimburse SUBRECIPIENT GRAPEVINE a total of$37,034 of JAG funds; CITY agrees to reimburse SUBRECIPIENT HALTOM CITY a total of$69,421 of JAG funds; CITY agrees to reimburse SUBRECIPIENT HURST a total of$78,713 of JAG funds; CITY agrees to reimburse SUBRECIPIENT KELLER a total of$10,933 of JAG funds; CITY agrees to reimburse SUBRECIPIENT KENNEDALE a total of$15,989 of JAG funds; CITY agrees to reimburse SUBRECIPIENT LAKE WORTH a total of$18,585 of JAG funds; CITY agrees to reimburse SUBRECIPIENT MANSFIELD a total of$38,400 of JAG funds; CITY agrees to reimburse SUBRECIPIENT NORTH RICHLAND HILLS a total of$83,633 of JAG funds; CITY agrees to reimburse SUBRECIPIENT RICHLAND HILLS a total of$9,019 of JAG funds; CITY agrees to reimburse SUBRECIPIENT SAGINAW a total of$14,486 of JAG funds; CITY agrees to reimburse SUBRECIPIENT WATAUGA a total of$24,188 of JAG funds; and CITY agrees to reimburse SUBRECIPIENT WHITE SETTLEMENT a total of$18,859 of JAG funds. The above parties agree to utilize their jurisdiction's individual award as outlined in the Memorandum of Understanding between the City of Fort Worth and the individual municipality or county. Section 3. It is expressly understood and agreed that, in the execution of this agreement, no party waives, nor shall be deemed hereby to waive, any immunity or defense that would otherwise be available to it against claims arising in the exercise of governmental powers and functions. Section 4. Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing of the services by the other party. Section 5. This Agreement creates no rights in any third party. Section 6. As to each individual party, this contract incorporates by reference the terms and conditions contained in the following three additional documents, as if set forth at length herein: (1) the Memorandum of Understanding between the City of Fort Worth and the individual municipality or county (2) the Grant Award Agreement and (3) the individual municipality's budget. With the exception of those aforementioned agreements and/or documents,this contract contains all commitments and agreements of the parties, and no oral or written commitments have any force or effect to alter any term or condition of this agreement, unless in writing and signed by authorized representatives of all parties. Conduct a public hearing regarding the application for a grant from the Recovery Act: Edward Byrne Memorial Justice Assistance Grant Formula Program to allow the public an opportunity to comment as required under the grant application; 2. Authorize the City Manager to apply for and accept,if awarded, a grant from the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, Recovery Act: Edward Byrne Memorial Justice Assistance Grant Formula Program,not to exceed$4,140,165.00; 3. Authorize the City Manager to Execute a Memorandum of Understanding to have the City of Fort Worth serve as the cognizant fiscal agency for the purpose of administrating this grant; and 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Grants Fund by$4,140,165.00, subject to receipt of the grant. DISCUSSION: The Recovery Act: Edward Byrne Memorial Justice Assistance Grant(JAG) Formula Program allows state and local governments to support a broad range of activities to prevent crime and to improve the criminal justice system. The City of Fort Worth, along with Cities of Arlington, Azle,Bedford,Benbrook, Crowley, Euless, Everman,Forest Hill, Grapevine,Haltom City, Hurst,Keller,Kennedale,Lake Worth,Mansfield, North Richland Hills,Richland Hills, Saginaw,White Settlement and Watauga are required to negotiate with Tarrant County to develop a program budget and strategy.All funds must be pooled,a spending plan must be developed and one agency must serve as the cognizant jurisdiction to apply for and disperse funds. A committee of all impacted law enforcement agencies developed an application strategy and the City of Fort Worth was selected to serve as the cognizant fiscal agency as it has for the past four years in connection with JAG Formula Programs. These equipment programs will include such items as hand—held ticket writing equipment, automated field training devices,driving simulators,recording equipment, and cell phone locating devices. Personnel will be hired on a short—term basis to update needs of the Police Department's website and database development improvements. Additionally,two grant—related administrative staff members will be hired to support the increased grant activity due to the availability of Recovery Act funding. No matching funds are required.
