HomeMy WebLinkAboutContract 49559-A5 AMENDMENT NO. 5 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES OLD HEMPHILL ROAD DROP-OFF STATION ADDITION STATE OF TEXAS 49559-A5 CITY SECRETARY CONTRACT NO. COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Elements of Architecture, Inc., (Consultant) made and entered into City Secretary Contract No. 49559 (The Contract) which was authorized by the City Council by M&C Reference No.: C-28324, the 151h day of August, 2017, for Old Hemphill Road Drop-Off Station Addition; and Amendments No. 1, No. 2, No. 3 & No. 4 were administratively executed in the amount of $64,461.00 for revisions to the PD site plan; and for additional signage design services, security modifications to existing site surveillance, and additional construction administration services due to changes in the construction sequence; and design services agreement for additional site lighting and provision for additional security cameras including photometric study to confirm light coverage to enhance security; and retaining wall foundation & Urban Forestry modifications, respectively; and WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for revisions to the existing scrap metal yard retaining wall structural design including tree location modifications. This additional service is in association with Amendment No. 4 which was directed by the Code Compliance Department. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I — Scope of Services, Paragraph (2) shall be added to read as follows: (2) Provide additional design, Architectural & Engineering, for the Drop-Off Station. The cost of this additional service is $9,580.00 without additional reimbursable expenses. The scope of services is described more fully in Elements of Architecture, Inc. Letter dated November 24, 2020, subject: "Proposal for Hemphill Drop-Off Center — Additional Services 05, Deep Foundation Designs and Tree Relocation at Scrap Metal Yard. 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "F". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "F". However the total fee paid by the City shall not exceed a total of $172,857.00 including $6,900.00 in reimbursable expenses unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." Fort Worth,Texas 76104 Phone 817.333.2880 Fax 817.333.2883 November 24, 2020 Alfonso Meza City of Fort Worth 401 West 13th Street Fort Worth, TX 76102 Re: Proposal for Hemphill Drop Off Center—Additional Services 05 Deep Foundation Designs and Tree Relocation at Scrap Metal Yard Dear Alfonso; Elements is pleased to provide you with this proposal for additional services associated with the retaining wall foundation modifications from a shallow spread footing design to a deep pier&grade beam foundation due to excavation depth, site limitations and anticipated costs by the GC. In addition, Urban Forestry modifications will be made addressing the relocation of two trees from within the circulation drive serving the proposed scrap metal yard. We understand that this includes review, coordination and a permit re-submittal as previously discussed. See proposal attached for Structural and Civil/Landscape services defined. TOTAL PROPOSED FEE Labor We propose to provide our services as identified in this proposal as follows: Architectural Services $1,330 Structural Services ($7000 x 1.1) $ 7,700 Civil/Urban Forestry($500 x 1.1) 550 TOTAL ADDITIONAL SERVICES $9,580 Fees listed above are for labor only. We have not included any expenses as we believe we can cover any expenses within our remaining balance. PROJECT TEAM The design team remains the same with RLWA, Carrillo and Elements providing services for this change to the scope. All firms are SBE certified. If this proposal meets with your approval,we would anticipate an amendment to our contract for services identified within this proposal.
