(Parcel 1) Dear Mr. Harry, This is a request by the City of Fort Worth for professional appraisal services. It is understood that this appraisal assignment has been prepared in accordance with the reporting requirements set forth under Standard Rule 2-2(a) of Uniform Standards of Professional Appraisal Practice (USPAP), and all local, state and federal requirements, except to the extent that the "Uniform Appraisal Standards for Federal Land Acquisition requires invocation of USPAP's Jurisdictional Exception Rule, as described in Section D- 1 of the Uniform Appraisal Standards for Federal Land Acquisitions." In addition, the appraisals must conform to the specific conditions contained herein. The appraiser shall certify in each report that any appraisal or update to an appraisal is prepared in strict accordance with the URA appraisal requirements. You are to take all reasonable steps to ensure that you and your organization divulge no information concerning your report to any other persons other than the City of Fort Worth without written authorization to do so. 1 Page R�C����U APR29 2014 Effective Date: October 31, 2013 Scope: City of Fort Worth vs. Vann Cattle Yards, Inc. (Parcel 1) 11 Update appraisal report due before May 16, 2014. 2) Provide various expert witness and appraisal consulting services in the case as directed by the City of Fort Worth's Legal Department and/or outside counsel Cantey Hanger, LLP. Work could involve production of your work file, deposition, appraisal review of the property owner's appraisal report(s), preparation and testimony in trial or mediation. Services may be needed up to the trial date tentatively scheduled for October 27, 2014. Commitment: Fee for the updated appraisal is $3,700.00 which will be invoiced upon submission of the report. It is our understanding that one (1) original and one (1) electronic copy of the appraisal report will be submitted to the addressee on or together with a statement of services. Litigation services will be billed based on an hourly billing rate of $200.00 per hour, invoiced at the end of each month or upon completion of the case. A summary of time and work billed will be submitted along with invoices that include hourly billing. The total amount billed shall not to exceed $18,700.00. Your statements should include the Purchase Order number provided, and should reference the Alliance Runway Extension - City of Fort Worth vs. Vann Cattle Yards, Inc. (Parcel 1). The City of Fort Worth reserves the right to accept the updated appraisals and will not be responsible for any expenses incurred by the assignment if wording or disclaimers are included limiting your professional liability to the City of Fort Worth. Conflict of Interest: All members and/or appraisal subcontractors of your organization certify that they have no personal, business or other relationship with the property's ownership, or have attached an explanation disclosing the nature of such relationship(s). Further, your acceptance of this assignment certifies that you agree not to accept or pursue the updated appraisal, or related assignments, of the subject property, or other assignments with the subject property's ownership (excluding limited partners and other financial institutions), for a period extending one year from the later of the date of this letter agreement, its delivery date, or the conclusion of ongoing or pending litigation without prior written consent of the City of Fort Worth. A penalty of $100.00 per business day will be deducted from the fee for reports delivered after the date stipulated above. No penalties will be imposed for delays resulting from circumstances beyond the appraiser's control; such circumstances judged for their validity solely by the City of Fort Worth, Department of Aviation. 2�Pa�e Your signature of this letter, to be returned to the authorized contact, will confirm our mutual understanding.
