FIRST AMENDMENT TO CITY SECRETARY
CONTRACT NO. 44344
WHEREAS, on April 18, 2014, the City of Fort Worth ("City") and Javier Villagomez
d/b/a GTO Construction, a sole proprietorship, ("Contractor") made and entered into City
Secretary Contract No. 44344 (the "Contract) for Lead -Safe Program (LSP) services as approved
by the City Council on February 19, 2013, in M&C G-17816;
WHEREAS, the Contract provided payment to Contractor for abatement of lead -based
hazards or lead -based paint for the Lead -Safe Program under the Lead Hazard Reduction and
Demonstration Program using grant funds received by the City from the United States
Department of Housing and Urban Development as accepted by the City Council on January 10,
2012, in M&C C-25398
WHEREAS, the Contract was for a 1 year term from April 18, 2013 through April 17,
2014 and provided for 4 additional 1 year extensions of the term;
WHEREAS, the Parties have agreed to extend the Contract for an additional 1 year term
beginning April 18, 2014 through April 17, 2015 and to revise the prices paid by City for
Contractor's services; and
WHEREAS, it is the mutual desire of City and Contractor to amend the Contract to meet
Contract objectives.
NOW, THEREFORE, City and Contractor hereby agree to amend the Contract as
follows:
I.
The first sentence of ARTICLE 5. TERM OF CONTRACT is amended to be and read
as follows:
"This Contract shall commence as of the Effective Date and shall automatically expire
upon the earlier of the expenditure of $300,000.00 or April 17, 2015 (the "Expiration
Date"), if not terminated sooner or extended as described below,"
II.
Attachment C attached to the Contract is hereby replaced with the attached Attachment
C Revised 03/2014.

All other terms and conditions of City Secretary Contract No. 44382 not amended herein
remain unaffected and in full force and effect, are binding upon the Parties, and are hereby
ratified by the Parties. Capitalized terms not defined herein shall have meanings assigned to
them in the Contract.
