SECOND AMENDMENT TO MAINTENANCE AGREEMENT
FOR FORENSIC SOFTWARE SERVICES
This Second Amendment Maintenance Agreement for Forensic Software Services is
entered into by and between the City of Fort Worth (hereafter "City"), a home rule municipal
corporation organized under the laws of the State of Texas, with its principal place of business at
200 Texas Street, Fort Worth, Texas by and through Jesus J. Chapa, its duly authorize Assistant
City Manager, and Oxygen Forensics, Inc. (hereinafter "Consultant"), a Commonwealth of
Virginia Corporation.
WHEREAS, City and Consultant entered into a Maintenance Agreement for Forensic
Software Services identified as Fort Worth City Contract No. 50107 ("Agreement") for a period
of one year beginning November 7, 2017 with up to three additional one-year periods by mutual
written agreement of the parties; and
WHEREAS, City and Consultant agreed to renew the Agreement for a third renewal term;
WHEREAS, City and Consultant now wish to amend the original Agreement to change
the term to unlimited one-year renewal periods by mutual written agreement of the parties;
WHEREAS, City and Consultant now wish to amend the original Agreement to increase
the overall contracted amount payable to Consultant by City for services provided under the
Agreement;
NOW, THEREFORE, City and Consultant, acting herein by the through their duly
authorized representatives, agree to the following terms, which amend the Agreement as follows:
1. The Agreement is hereby amended by replacing section 2 in its entirety with the
following:
This Agreement shall commence upon November 7, 2017 ("Effective Date") and
shall expire on November 6, 2018, unless terminated earlier in accordance with
the provisions of this Agreement. The Agreement may be renewed for unlimited
one-year periods by mutual written agreement of the parties.
2. The Agreement is hereby amended by replacing section 3 in its entirety with the
following:
As full and complete compensation for all Services described above, Consultant
shall be paid a fee of Two Thousand Eight Hundred Ninety Nine Dollars and 00/100
($2,899.00) in accordance with the provisions of this agreement. Consultant shall
not perform any additional services for the City not specified by this Agreement

unless the City requests and approves in writing the additional costs for such
services. The City shall not be liable for any additional expenses of Consultant not
specified by this Agreement unless the City first approves such expenses in writing.
3. All other provisions of the Agreement which are not expressly amended herein
shall remain in full force and effect.
