FIRST RENEWAL AND FIRST AMENDMENT OF CITY SECRETARY CONTRACT NO.53054
A NON-EXCLUSIVE MOWING AND GROUNDS MAINTENANCE SERVICES AGREEMENT
FOR EAST DISTRICT CITY PROPERTIES BETWEEN THE CITY OF FORT WORTH AND
SCOTT LANDSCAPE MAINTENANCE,INC.
This FIRST RENEWAL AND FIRST AMENDMENT OF CITY SECRETARY CONTRACT
NUMBER 53054 ("First Renewal and First Amendment") is made and entered into by and between the
CITY OF FORT WORTH ("City"), a home-rule municipal corporation of the State of Texas, acting by
and through its duly authorized Assistant City Manager, and SCOTT LANDSCAPE MAINTENANCE,
INC. ("Contractor"), a Texas limited liability company, acting by and through its duly authorized
representative.
WHEREAS, the City and Contractor entered into a non-exclusive mowing and grounds
maintenance services agreement,City Secretary Contract Number 53054("Agreement");
WHEREAS, the Agreement provides for a primary term of one year, with four (4) subsequent
one-year renewal options;
WHEREAS,the initial one-year term expired on November 30,2020;
WHEREAS,the parties desire to exercise the first one-year renewal term, effective beginning on
December 1,2020 and ending on November 30,2021;
WHEREAS, the parties further desire to increase the aggregate amount of the Agreement from
$230,000 to$287,500;
WHEREAS, the parties also desire to amend portions of Exhibit B concerning the pricing
schedule for certain locations; and
NOW, THEREFORE, in consideration of the mutual covenants and promises set forth herein
and other good and valuable consideration,the sufficiency of which is hereby acknowledged,the City and
Contractor agree to renew and amend the Agreement as follows:
I.
The City and Contractor agree to renew and extend the Agreement for the first renewal term of
one year,effective beginning on December 1,2020 and ending on November 30,2021.
II.
Section 2.2,"SCOPE OF WORK",of the Agreement is revised to increase the aggregate amount
of the Agreement from$230,000.00 to$287,500.00 and is amended to read as follows:
"2.2 Contractor understands and agrees that the City will award non-exclusive
purchase agreements to multiple bidders for mowing and grounds maintenance
services as outlined in City of Fort Worth Bid Solicitation (ITB/RFP No. 19-
0000010), which is attached to the Agreement as Exhibit B, and incorporated
herein for all purposes. Contractor further understands that the aggregate amount
of all contracts awarded to multiple contractors under (ITB/RFP No. 19-
0000010) is in the amount of $287,500.00, and the City makes no promise or
guarantee of the total amount of work that will be assigned to Contractor under

this Agreement. Contractor's Response to City of Fort Worth ITB/RFP No. 19-
0000010 ("Contractor's Response") is attached to the Agreement as Exhibit C,
and incorporated herein for all purposes."
III.
Exhibit C of the Agreement is hereby amended to revise the pricing schedule for the specific
locations set forth below. All other locations in Exhibit C remain unaffected by this First Renewal and
First Amendment.

1. All other terms and conditions of the Agreement remain in full force and effect except as
specifically set forth in this First Renewal and First Amendment.
2. All terms of this First Renewal and First Amendment that are capitalized but not defined
have the meanings assigned to them in the Agreement.

IN WITNESS WHEREOF, the City and Contractor have executed this First Renewal and First
Amendment to be effective on December lst,2020.
