AMENDMENT NO. 1 TO CITY SECRETARY CONTRACT NO. 53775 FORT WORTH WATER DEPARTMENT RETAIL WATER AND WASTEWATER COST OF SERVICE & RATE STUDY This AMENDMENT is entered into by and between the CITY OF FORT WORTH (hereafter "City"), a home rule municipal corporation situated in portions of Tarrant, Denton, Parker and Wise Counties, Texas, with its principal place of business at 200 Texas Street, Fort Worth, Texas, and SLACK & VEATCH MANAGEMENT CONSULTING, LLC (hereafter "Consultant"), a Limited Liability Company. WHEREAS, the parties have entered into City Secretary Contract No. 53775 (the "Contract"), on April 6, 2020; and WHEREAS,the Contract provides that Consultant shall perform a retail water and wastewater cost of service &rate study and rate model; and WHEREAS, the term of the Contract expires on September 30, 2020; and WHEREAS, the City and Consultant, now wish to extend the term of the Contract, increase the not to exceed amount and to amend the scope of work to provide for additional model enhancements to facilitate analysis with regards to debt service. NOW, THEREFORE, City and Consultant acting herein through their duly authorized representatives, enter into the following agreement to amend the Contract: 1. Section_1,_SCOPE OF WORK. "Exhibit A" to the Contract, Phase 111, Task_3 shall be amended to in include Subtask_3.3 to provide the City with additional retail rate model enhancements to facilitate scenario analysis with regards to debt service and rate design. 2. Section 2, TERM. The term of the Contract is hereby retroactively amended to extend the term to February 28, 2021, unless terminated earlier in accordance with the Contract. The not to exceed amount to the Contract shall be increased by$5,000 to provide for the additional scope of services and shall now be $70,450. 4. All other provisions of the Contract which are not expressly amended herein shall remain the same. Executed on the day signed by the City Secretary as noted below.
