TERMINATION OF ENCROACHMENT LICENSE AGREEMENT
This TERMINATION OF ENCROACHMENT LICENSE AGREEMENT is made
and entered into by and between the CITY OF FORT WORTH ("City"), a Texas home rule
municipal corporation of Tarrant County,Texas, acting herein by and through its duly authorized
City Manager, Assistant City Manager, or Development Services Department Director, and
BURNETT PLAZA LP ("Licensee"), a Texas limited partnership, successor-in-interest to Bank
of Texas, acting herein by and through its duly authorized representative.
RECITALS
WHEREAS, City and Licensee made and entered into City Secretary Contract No. 36683
(the"Agreement"),on February 1,2008,to authorize Licensee's encroachment upon the City's Public
Right-of-Way for the purpose of installation of(1)set of 39"/14"reverse channel letters and logo on
east elevation, (4)sets of 14"channel letters with 40.25"logo to be installed on north, south and west
elevation on Burnett Plaza and west elevation of parking garage, installation of(1) set of 34.5"/12"
reverse channel letters to be installed on concrete monument; and
WHEREAS, the parties now wish to terminate the Agreement.
NOW,THEREFORE,City and Licensee,acting herein by and through their duly authorized
representatives, enter into the following agreement:
1.
The Agreement is hereby terminated effective on March 3, 2021.
2.
Pursuant to Section 19 of the Agreement, the parties hereby agree that the requirements of
Section 8 of the Agreement shall survive this termination.
