SECOND RENEWAL TO CITY SECRET ARY
CONTRACT NO. 51240
This Second Renewal to City Secretary Contract Number 51240 ("Second Renewal") is by and bet een
the City of Fort Worth ("City "), a home-rule municipality organized under the laws of the State ofT as ,
acting by and through its duly authorized Assistant City Manager, and Nu, Inc., D/B/A Nu-Design, a ing
through Kelly Hart, its Vice President (the "Contractor"). The City has designated the Arts Counc I of
Fort Worth and Tarrant County, Inc. as its Contract Manager to manage this agreement on its behalf.
WHEREAS, the City is implementing the Fort Worth Public Art Program pursuant to the
Chapter 2, Section 2-56 through 2-61 of the Fort Worth Code of Ordinances to insure proper steward hip
of the City's public art collection;
WHEREAS, the City and Contractor entered into a Professional Services Agreemen on
September 10 , 2018 for services related to information technology, programming, and lighting system on
an as needed basis for the Public Art Collection, the same being City Secretary Contract ("CSC ") No.
51240 ("the Agreement");
WHEREAS , the Contract provided for an initial one-year term and for the possibility of t ree
one-year renewals, at the sole discretion of the City ;
WHEREAS , on January 7, 20 I 9 the City and Contractor executed Addendum No. 1 (CSC No.
51240-AD I for Contractor to perform work on a public art work titled "Avenue of Light" to rep ace
certain lighting that had been damaged;
WHEREAS, subsequently, the parties entered into the First Renewal Term which expire , on
September 30, 2020 (CSC No. 51240-Rl);
WHEREAS, the City and Contractor have continued to operate under the terms and conditio s of
the Contract and desire to continue the relationship by extending and renewing the agreement fo an
additional renewal period effective October I, 2020 and expiring on September 30, 2021;
NOW, THEREFORE, City and Contractor do covenant and agree as follows:

The City and Contractor hereby agree to renew and extend the Agreement for a one-year ren wal
period , effective on the I st day of October 2020 , and ending on September 30, 2021 ("Second Ren wal
Term ").
2.
All terms and conditions of the Agreement shall remain in full force and effect during the Se ond
Renewal Term unless specifically amended herein.

All terms in this Second Renewal that are capitalized but not defined shall have the mean ngs
assigned to them in the Agreement.
