FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER 54635
A COMMUNITY FACILITIES AGREEMENT BETWEEN
THE CITY OF FORT WORTH AND PMB VENTANA DEVELOPER LLC
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NUMBER
54635 ("First Amendment") is made and entered into by and between the City of Fort Worth,
a home-rule municipal corporation of the State of Texas ("City"), and PMB Ventana
Developer LLC, a TeXas limited liability company ("Developer").
WHEREAS, the City and Developer entered into a Community Facilities Agreement
for the construction of public infrastructure improvements for a project generally described as
Ventana Pumping Facility Hydropneumatic Tank Addition, City Secretary Contract Number
54635 ("CFA"); and
WHEREAS, the CFA was executed based on an engineer's estimate of probable cost
in accordance with Section 9-315 of the City Code; and
WHEREAS, the actual construction cost for the CFA eXceeds the engineer's estimate
of probable cost; and
WHEREAS, the City and Developer desire to amend the CFA in accordance with
Section 9-315 of the City Code to reflect the actual construction cost and the increase in the
financial guarantee;
NOW THEREFORE, City and Developer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends City Secretary
Contract No. 54635:
1.
Section 34 of the CFA is amended to be and read as set forth in Exhibit "A" of this First
Amendment.
2.
The Cost Estimate of the CFA is amended to be and read as set forth in EXhibit "B" of
this First Amendment.
3.
a. All other provisions of the CFA, which are not expressly amended herein, shall
remain in full farce and effect.
b. All terms in this First Amendment that are capitalized but not defined shall have
the meanings ascribed to those terms in the CFA.
