Schutz, Inc. d/b/a Circle C Construction Company ("Contractor"), collectively the ("Parties"), made apd entered into City Secretary Contract No . 38370 (M&C C-23384) (the "Contract") for Sew er Main Rehabilitation Pipe Enlargement Contract 2008A with services to be performed at vari us locations citywide; and WHEREAS , the Contract was renewed on June 14 , 2011 (M&C C-24982) and 1s approaching the end of its financial term ; and WHEREAS, the Contract may be renewed up to two times at the same terms , conditio and unit prices as originally bid ; and WHEREAS, in order to protect the public 's funds , the contractor will be bound to t e unit prices as found in the bid tabulation section of the original agreement. NOW, THEREFORE, the Parties, hereby agree as follows: a. b. C. L. Contract No . 38370 is renewed for another term in the amount of $1 ,000 ,000.00. The Unit Prices originally bid by Contractor upon which basis the Contract w L awarded , shall remain in effect for the duration of the Contract, as renewed. Task orders will continue to be issued and remain contingent upon the availabili ,y of funds and the availability of the contractor. II. DISCUSSION: On March 3, 2009, (M&C C-23384) the City Council authorized a contract in the amount of $1 ,000 ,000.00 with William J . Schultz , Inc. d/b/a Circle "C" Construction Company for Sewer Main Rehabilitation Pipe Enlargement Contract 2008A with two renewals . T he bid documents included a stipulation that the total quantities listed may not reflect actual quantities and are based on the budgeted amount of $1 ,000 ,000 .00 . Final payments will be made based on actual measured quantities. Funding will be provided ind ividually for each work order priojr to its release. The bid documents also included a stipulation giving th e City the option to renew th is contract twice under the same terms, conditions and unit prices if both parties a re agreeable . The work performed under this contract consists of replacing deteriorated sewer mains at various locations throughout the City that have exhibited recurri ng maintenance problems, are under existing structures or in inaccessible locations where open trench methods of construction would be impossible. William J . Schultz, Inc., d/b/a Circle "C" Construction Company is in compliance with the City's M/WBE Ordinance by committing to 17 percent M/WBE participation.
