SUBJECT: Authorize Execution of a Contract with The Fain Group, Inc., in the Amount of$492,080.46 for the
Construction of Pedestrian and Streetscape Improvements in the Berry/Riverside Urban Village on
East Berry Street Between Yuma Street and the Sycamore Creek Bridge(COUNCIL DISTRICT 8)
RECOMMENDATION:
T It is recommended that the City Council authorize the execution of a contract with The Fain Group,
Inc., in the amount of$492,080.46 for the construction of pedestrian and streetscape improvements in
the Berry/Riverside Urban Village on East Berry Street between Yuma Street and the Sycamore
Creek Bridge.
DISCUSSION:
On September 23, 2008,the City Council authorized the execution of an engineering Agreement with
Freese and Nichols, Inc.,to design pedestrian and streetscape improvements in the Berry/Riverside
Urban Village(M&C C-23069). Public meetings were held with property owners and stakeholders of
the Berry/Riverside Urban Village on two occasions to receive their input on the streetscape elements.
Texas Department of Transportation (TxDOT)completed its review of the design plans and approved
the project for letting on May 15,2012.
This project consists of the following pedestrian and streetscape improvements: construction of new
sidewalks, curb and gutter, decoratively stained crosswalks, installation of pedestrian lights, and other
decorative pavement treatment in association with public art collage banners and poles at the
northeast and southwest comers of the East Berry and Riverside intersection.
The estimated construction costs are as follows:
IStreetscape Construction $492,080.46
Survey, Material Testing, Inspections,
$x7,721.92
etc.
Pedestrian Lights $65,838.00
Construction Mana ement $19,604.61
Ten Percent Contingency 9 y $49,20$.05
Total =$684.11463.04
'rhe streetscape construction, survey, material testing, inspections, etc., and the contingency is
funded by Federal Highway Administration grant funds in the amount of$599,010.43. The amount for
the pedestrian lights will be funded by the City's Street Light and Signal Improvements Fund in the
amount of$65,838.00.The estimated construction management fee is funded by the 2004 Capital
Improvement Program New Development Fund in the amount of$19,604.61.
The design, fabrication, and installation of the public art collage banners and poles, estimated at
$50,000.00, is additional to the project and funded by the Fort Worth Public Art Fund.
The project was advertised for bids on May 31, 2012 and June 7,2012 in the Fort Worth Star-
Te1ogram in compliance with TXDOT requirements.

22 below the finished grade to allow for a 4"sidewalk to be paved over and across
23 the light pole foundation). The overall length of the light pole foundation shall
24 be as shown in the plans. The sidewalk pavement shall be placed over the entire
PM 25 foundation and stained the same as the adjacent concrete.

28 "3.The pedestal electric service equipment shall be furnished by the City of

2 AGREEMENT
3 AGREEMENT THIS AGREEMENT,is made by and between
4 The Ci ty of Forth Worth a home rule municipal co ration in the State of Texas,acting by and
5 through its City Manager,hereinafter called C ity,and THE FAIN GROUP,INC.,authorized to
6 do business in Texas,acting by and through its duly authorized representative,hereinafter called
7 Contractor.City and Contractor, in consideration of the mutual covenants hereinafter set forth,
8 agree as follows:
9 Article 1.WORK
10 Contractor shall complete all Work as specified or indicated in the Contract Documents for the
11 Project identified herein.
12 Article 2.PROJECT
13 The project for which the Work under the Contract Documents may be the whole or only a part is
14 generally described as follows:

18 Article 3.CONTRACT TIME
19 3.1 Time is of the essence.
20 All time limits for Milestones, if any,and Final Acceptance as stated in the Contract
21 Documents are of the essence to this Contract.
P■ 22 3.2 Final Acceptance.
23 The Work will be complete for Final Acceptance within 109 days after the date when the
24 Contract Time commences to run as provided in Paragraph 2.03 of the General Conditions.
25 3.3 Liquidated damages
26 Contractor recognizes that time is of the essence of this Agreement and that City will
27 suffer financial loss if the Work is not completed within the times specified in Paragraph
28 3.2 above,plus any extension thereof allowed in accordance with Article 12 of the
29 General Conditions. The Contractor also recognizes the delays,expense and difficulties
30 involved in proving in a legal proceeding the actual loss suffered by the City if the Work
31 is not completed on time.Accordingly, instead of requiring any such proof,Contractor
32 agrees that as liquidated damages for delay(but not as a penalty),Contractor shall pay
33 City Five Hundred Ninety and no/100 Dollars(5590.00),in accordance with TxDOT
34 Special Provision 000---2332 Schedule of Liquidated Damages for each day that expires
35 after the time specified in Paragraph 3.2 for Final Acceptance until the City issues the
36 Final Letter of Acceptance.

95 7.1 Terms.
96 Terms used in this Agreement which are defined in Article 1 of the General Conditions will
97 have the meanings indicated in the General Conditions.
98 7.2 Assignment of Contract.
99 This Agreement, including all of the Contract Documents may not be assigned by the
104 Contractor without the advanced express written consent of the City.
i o 1 7.3 Successors and Assigns.
102 City and Contractor each binds itself, its partners, successors, assigns and legal
103 representatives to the other party hereto,in respect to all covenants,agreements and
104 obligations contained in the Contract Documents.
105 7.4 Severability.
106 Any provision or part of the Contract Documents held to be unconstitutional, void or
107 unenforceable by a court of competent jurisdiction shall be deemed stricken, and all
108 remaining provisions shall continue to be valid and binding upon CITY and
109 CONTRACTOR.

114 7.6 Other Provisions.
115 The Contractor agrees to pay at least minimum wage per hour for all labor as the same is
116 classified,promulgated and set out by the City,a copy of which is attached hereto and
117 made a part hereof the same as if it were copied verbatim herein.
