HomeMy WebLinkAboutContract 54632-A1 CSC No. 54632-A1 AMENDMENT NO. 1 TO FORT WORTH CITY SECRETARY CONTRACT NO. 54632 This First Amendment to Fort Worth City Secretary Contract No. 54632 (First Amendment") is made between the City of Fort Worth ("Fort Worth"), a municipal corporation through Dana Burghdoff, Assistant City Manager and HACH Company ("Vendor") an entity authorized to perform work in Texas, acting through Roxanna Starika, its duly authorized Project Specialist 11. WHEREAS, Fort Worth and Vendor entered into a Sole Source Agreement for the purchase of laboratory supplies,replacement parts and maintenance services with a term beginning September 14, 2016 and expiring on September 13, 2017 with four (4) one (1) year options to renew and a not to exceed amount of$431,000; and WHEREAS, Fort Worth and Vendor have exercised the four options to renew and the Agreement expires on September 13, 2021 (the "Agreement"); and WHEREAS, the Agreement allowed for a $50,000 administrative change order which the Water Department instigated on or about May 9, 2021 and which this First Amendment now ratifies; and WHEREAS,the parties have agreed to amend the not to exceed amount of the Agreement by an additional $100,000 which the City Council approved by M&C 21-0455 on June 22, 2021 to accomplish the scope of services of the Agreement. NOW THEREFORE,known by all these present,Fort Worth and Vendor, acting herein by the through their duly authorized representatives, agree to amend the not to exceed amount of the Agreement as follows: 1. NOT TO EXCEED AMOUNT The not to exceed amount for this Agreement is hereby amended to be $581,000.00 to include the amount of the administrative change order of$50,000 and the $100,000 approved by M&C 21- 0455. 2. DISCUSSION: On September 13, 2016, the City Council approved Mayor and Council Communication(M&C) P-11933, authorizing a sole source agreement with Hach Company for an annual amount up to$431,000.00 for Original Equipment Manufacturer(OEM)Hach Laboratory Supplies, Replacement Parts and Maintenance on turbidmeters and other instrumental measuring equipment for the Water Department. The City Council also authorized an administrative change order in the amount of$50,000 as approved by the City Manager. On or about May 9, 2021, the Water Department instigated the change order increasing the annual amount by$50,000 which this amendment, if approved will ratify in writing. In 2021, the Water Department determined that additional funding is needed due to increases in the number of parts and services needed. An increase to the agreement will continue the Water Department's ability to preserve and protect the public health and/or safety of the City of Fort Worth's residents. Staff recommends amending the sole source agreement to add an additional$100,000.00 for the Water Department for a new annual amount of $581,000.00. As this sole source agreement is in its last renewal period,there is no option to renew. Hach Company is the documented sole source for Original Equipment Manufacturer(OEM)Hach Laboratory Supplies, Replacement Parts and Maintenance. M/WBE OFFICE-Hach Company is the documented sole source vendor for these supplies, replacement parts and maintenance. A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department and approved by the Business Equity Division, in accordance with the BIDE Ordinance, because the MBE/SBE is based on the sole-source information provided to the Business Equity Division by the managing Department's project manager. This project is located in all districts. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that funds are available in the operating budget, as appropriated, of the Water and Sewer Fund and that prior to an expenditure being made, the Water Department has the responsibility to validate the availability of funds.
