HomeMy WebLinkAboutContract 50092-A2 CSC No.50092-A2 AMENDMENT No.2 TO CITY SECRETARY CONTRACT No. 50092 WHEREAS, the City of Fort Worth (CITY) and Dunaway Associates, LLC, (ENGINEER) made and entered into City Secretary Contract No . 50092, (the CONTRACT) which was authorized by M&C C-28506 on the 12 day of December, 2017 in the amount of $ 650, 000 . 00; and WHEREAS, the CONTRACT was subsequently revised by: Amendment Number 1 in the amount of $170, 000 which was authorized by M&C # 19-0067 on August 20, 2019, and WHEREAS, the CONTRACT involves engineering services for the following project : FY 2018 SAFE ROUTES TO SCHOOL (SRTS) IMPROVEMENTS; and WHEREAS, it has become necessary to execute Amendment No . 2 to the CONTRACT to include an increased scope of work and revised fee . NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT : 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $97, 900 . 00 . (See Attached Funding Breakdown Sheet, Page -4-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $917, 900 . 00 . 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect . As part of this agreement, a Task Order with detailed Scope of Services was executed on April 5th, 2018. Since original project execution, the scope of design and construction changed and was reevaluated significantly resulting in unanticipated management and design costs. On September 17, 2019, Amendment No 1 to the original contract was executed which adjusted the remaining funds and allocated $170,000 in additional funds to cover Project Management, Design Phase Services and ROW/Easement Services and Bid Phase Services. It was understood that funds required for completing the project through Construction Phase services would be requested at a later time. After Amendment No 2 funding approval, the City requested Dunaway expand the scope of design services to review, with multiple rounds of iterations, design changes to residential drives with the intention of limiting the amount of right of way necessary. This included numerous adjustments to related ramps and sidewalks. There were additional design revisions requested related to sidewalk and right-of-way along Azel Avenue. Finally, because of the length of time elapsed, NEPA documents required updating. This request additionally includes costs for TDLR review and inspection. This letter is to formally request that the current task order funding limit be increased $97,900.00 from $820,000 to $917,900 HNTE to cover the costs of these additionally requested scope of design services, TDLR inspection coordination, and to complete the project through Construction Phase Services as currently agreed to in the existing Scope of Services signed April 5th, 2018. We feel that this amount is a conservative estimate for necessary funds to complete the project through construction phase services and project close out with a commitment to a high level of service to the City of Fort Worth. FINAL DESIGN (90 PERCENT) AND FINAL CONSTRUCTION DOCUMENTS (100 PERCENT). • Upon approval of the Preliminary plans, ENGINEER will prepare construction plans as follows: • Final draft construction plans (90%) and specifications (TxDOT standard) shall be submitted to CITY per the approved Project Schedule. • Following a 90% construction plan review meeting with the CITY, the ENGINEER shall submit Final Plans (100%) to the CITY per the approved Project Schedule. Each plan sheet shall be stamped, dated, and signed by the ENGINEER registered in State of Texas. The ENGINEER shall submit a final design estimate of probable construction cost with both the 90% and 100% design packages. This estimate shall use TxDOT standard bid items. ENGINEER will support the construction phase of the project as follows. 6.1 Construction Support • The ENGINEER shall attend the preconstruction conference. The CITY shall select a suitable location and mail the invitation letters to the affected customers. • The ENGINEER shall visit the project site at requested intervals as construction proceeds to observe and report on progress. • The ENGINEER shall review shop drawings, samples and other submittals submitted by the contractor for general conformance with the design concepts and general compliance with the requirements of the contract for construction. Such review shall not relieve the Contractor from its responsibility for performance in accordance with the contract for construction, nor is such review a guarantee that the work covered by the shop drawings, samples and submittals is free of errors, inconsistencies or omissions. The ENGINEER shall log and track all shop drawings, samples and other submittals in Buzzsaw. • As requested by the CITY, the ENGINEER shall provide necessary interpretations and clarifications of contract documents, review change orders, and make recommendations as to the acceptability of the work. • The ENGINEER shall attend the "Final' project walk through and assist with preparation of final punch list. 6.2 Record Drawings • The ENGINEER shall prepare record drawings from information provided by the CITY depicting any changes made to the Final Drawings during construction. The following information shall be provided by the CITY: o As-Built Survey o Red-Line Markups from the Contractor o Red-Line Markups from City Inspector o Copies of Approved Change Orders o Approved Substitutions • The ENGINEER shall modify the Final Drawings electronically and shall place a stamp on the plans indicating that they represent Record Drawings of the project as constructed. The stamp shall be signed and dated by the ENGINEER and shall be placed on each plan sheet, whether there are any revisions on the sheet or not. ENGINEER is not obligated to incur costs beyond the indicated budgets, as may be adjusted, nor is the City obligated to pay ENGINEER beyond these limits. If ENGINEER projects, in the course of providing the necessary services, that the PROJECT cost presented in Article 2 of this Agreement will be exceeded, whether by change in scope of the project, increased costs or other conditions, the ENGINEER shall immediately report such fact to the City and, if so instructed by the City, shall suspend all work hereunder.
