Notice of Establishment of a RR Quiet Zone under 49 CFR 222.39(b)(1) and under Appendix B to Part 222 I.A This letter and the attachments are a Notice of Establishment (NOE) for the creation of a quiet zone under 49 CFR 222.39(b)(1) and Appendix to Part 222 I.A . As required by the Federal Railroad Administration under 49CFR 222.43, the following information is provided to you and other parties. EFFECTIVE DATE OF QUIET ZONE -222.43(d)(1)(i) Routine use of the locomotive horn at the crossings listed below shall cease effective 21 days from the date of mailing. LIST OF HIGHWAY RAIL-GRADE CROSSINGS within the QUIET ZONE—222.43(d)(2)(i) All public highway-rail grade crossings to be included within the proposed quiet zone are: Crossing ID Street Name Location on Street Improvements 795350 M Timberland Boulevard 12600 Block Median Barrier The City of Fort Worth plans to implement a quiet zone at this crossing with the improvements described below. Timberland Boulevard—Alternate Safety Measure (ASM) Timberland Boulevard is an existing seven-lane divided highway with concrete non-traversable medians. The crossing is equipped with flashing lights and gates, constant warning circuitry, and power-out indicators. There is an existing traffic signal located at Timberland Boulevard and US Highway 377 that is interconnected with the railroad equipment to provide advance preemption operation. Although there are concrete non-traversable medians at this location, they do not comply with the length requirements to be considered as a Supplemental Safety Measure (SSM). The median on the west side of the crossing is over 200 feet in length and the median to the east of the crossing is approximately 50 feet in length due to a parallel highway. The median height is a minimum of 6" as required by the rule for non-traversable curb. As a result, this modified SSM will be treated as an ASM in establishment of the quiet zone. DIAGNOSTIC TEAM REVIEW-222.43(d)(2)(iii) A diagnostic team review is not required for this quiet zone under 222.25 or 222.27. However, the agency did invite State agency representatives, all affected railroads, and the FRA to attend a diagnostic team review that was conducted on March 9'h, 2021 TIME PERIOD FOR HORN RESTRICTION -222.43(d)(2)(iv) The quiet zone is proposed to restrict the routine sounding of locomotive horns 24 hours a day. EXISTING GRADE CROSSING INVENTORY FORMS -222.43(d)(2)(y) An accurate and complete grade crossing inventory form for each public, private, and pedestrian grade crossing within the quiet zone that reflects conditions existing at the crossings before quiet zone improvements were made are provided in Attachment C. QUIET ZONE GRADE CROSSING INVENTORY FORMS -222.43(d)(2)(vi) An accurate and complete grade crossing inventory form for each public, private, and pedestrian grade crossing within the quiet zone that reflects ASMs and SSMs in place upon establishment of the quiet zone are provided in Attachment D. NOTICE OF INTENT—222.43(d)(2)(vii) A Notice of Intent to Establish a New Quiet Zone at the above listed location was sent, by certified mail — return receipt requested, to all railroads operating over the public grade crossing within the proposed quiet zone, the State agency responsible for grade crossing safety, and the State agency responsible for highway and road safety on May 7, 2020. The City is seeking FRA's approval of the suggested effectiveness rate for the proposed alternative safety measure (ASM) at the Timberland Boulevard crossing. • The City asserts that the proposed ASM at the Timberland Boulevard crossing will consist of a 50-foot non-traversable median on the east side of the crossing, due to an intersection; and, a 200-foot non-traversable median on the west side of the crossing. DISCUSSION: The 2014 Bond Program included Timberland Boulevard as an arterial improvement project from Excelsior Lane to United States (U.S.) Hwy 377 to provide greater access and mobility for the community. The improvement project widened Timberland Boulevard to a four lane divided arterial with sidewalks, to include connections to both Katy Road and U.S. Hwy 377. The Timberland Boulevard connection to U.S. Hwy 377 required access crossing the existing Union Pacific Railroad (UPRR) Facilities. The project was delivered in three phases. On January 30, 2018 City Council authorized Railroad At-Grade Crossing and Pipeline Agreement permits for the construction of Timberland Boulevard across the existing UPRR Facilities. These improvements allowed for the crossing to be converted to a quiet zone after completion of construction. The improvements include new railroad signals and a roadway crossing on UPRR property. On May 7, 2020, City of Fort Worth (City) staff sent all parties: UPRR, Texas Department of Transportation Railroad Section, Federal Railroad Administration (FRA), City of Keller and City of Fort Worth Police a Notice of Intent (NOI) letter proposing creation of a quiet zone for UPRR at Timberland Boulevard, in Fort Worth, Texas. The proposed quiet zone is to restrict the routine sounding of locomotive horns 24 hours a day. This action began a 60 day comment period for the proposed quiet zone that ended on July 7, 2020. The City of Keller responded stating that the intent to establish a railroad quiet zone is fully supported. No other responses were received during the comment period. In December 2020, Phase Three of Timberland Boulevard from Park Vista Boulevard to U.S. Hwy 377 was completed. On February 4, 2021, the City of Fort Worth entered into an agreement with UPRR in the amount of $15,000.00 for UPRR quiet zone services to establish a quiet zone for Timberland Boulevard at UPRR 795350M. On March 16, 2021, City staff sent FRA the Public Authority Application proposing a quiet zone for Timberland Boulevard, in Fort Worth, Texas. FRA responded on August 9, 2021, approving the City's application for the quiet zone. The final step is for the City of Fort Worth to send a notice of quiet zone establishment for Timberland Boulevard at Union Pacific Railroad Crossing 795350M to all parties.
