THIRD AMENDMENT
TO CITY SECRETARY CONTRACT NO. 52947,
EASEMENT ENCROACHMENT LICENSE AGREEMENT
The THIRD AMENDMENT TO CITY SECRETARY CONTRACT NO. 52947,
EASEMENT ENCROACHMENT LICENSE AGREEMENT is made and entered into by and
between the CITY OF FORT WORTH, a home rule municipal corporation of Tarrant County,Texas
("City"), acting herein by and through its duly authorized City Manager, Assistant City Manager, or
Development Services Department Director, and Cook Children's Medical Center, a domestic
nonprofit organization ("Licensee"), acting herein by and through its duly authorized Vice President
RECITALS
WHEREAS, City and Licensee made and entered into City Secretary Contract No. 52947 on
October 18, 2019 (the"Agreement"),to authorize the use of the City's easement for the purposes of
installing soldier piers; and
WHEREAS, City and Licensee made and entered into City Secretary Contract No. 52947-A1 on
May 11,2020 (the "First Amendment"), to authorize the use of the City's easement for the purposes of
including installation of private storm, grate inlet and curb inlet ; and
WHEREAS, City and Licensee made and entered into City Secretary Contract No. 52947-A2 on
July 13, 2020 (the "Second Amendment"),to authorize the use of the City's easement for the purposes
of including installation of including approximately 151 LF of 1" conduit,4 private pedestrian
streetlights,8 bollards and 91 SY of colored concrete pavement; and
WHEREAS,the parties wish to amend the Agreement to include canopy, columns for canopy,
warning lights to pedestrian crosswalk, 1" conduit, changes to streetlight pole,water,sewer and
color concrete pavement along Pruitt Street(private street); and

WHEREAS, it is the mutual desire of City and Licensee to execute this Amendment to the
Agreement to revise"Exhibit A" in the Agreement to depict the revised encroachment area.
NOW, THEREFORE, City and Licensee, acting herein by and through their duly authorized
representatives, enter into the following that amends the Agreement:
1.
"Exhibit A" in the Agreement is hereby replaced with the attached revised description of the
encroachment area, labeled as "Revised Exhibit A."
2.
The effective date of this Amendment shall be the date of its execution by the City.
3.
All other provisions of the Agreement which are not expressly amended herein shall remain in
full force and effect.
