THIRD AMENDMENT TO
CITY SECRETARY CONTRACT NO. 52535
THIS THIRD AMENDMENT to City Secretary Contract No. 52535 is entered into
by and between the City of Fort Worth ("City"), a home-rule municipality in the State
of Texas, acting through Valerie Washington, its duly authorized Assistant City
Manager, and Terracon Consultants, Inc., a Delaware corporation ("Contractor"),
acting through Kyle Burroughs, its duly authorized Senior Principal/Regional
Manager. City and Contractor may be referred to herein individually as a Party, or
collectively as the Parties.
WHEREAS, the City and Terracon Consultants, Inc. have entered into City
Secretary Contract No. 52535 (also the "Agreement") commencing on July 12,
2019 for professional services for environmental and engineering consulting
projects during the term of the agreement as authorized by Mayor and Council
Communication C-27811; and
WHEREAS, the Agreement was for an initial term of one year and up to four
extension options of one year each; and
WHEREAS, the Parties agree that all other conditions, terms, and pricing shall
remain the same as stated in City Secretary Contract No. 52535, as amended; and
NOW, THEREFORE, for and in consideration of the mutual covenants contained
herein, and other good and valuable consideration, the receipt and sufficiency of
which are hereby acknowledged and confessed, the Parties hereto agree as
follows:
1. Extended term of Agreement:
City Secretary Contract number 52535 will be extended, through annual one-year
term renewals, for an additional two years, through December 2025.
2. Compensation Not to Exceed Amount:
Compensation shall not exceed two hundred and five thousand dollars
($205,000.00) for the term of this amendment and all future amendments,
respectively, billable according to the fee schedule and subject to all other terms
and conditions as stated in City Secretary Contract number 52535, as amended,
and subject to prior duly authorized and executed amendments.

3. Scope of Services
In addition to brownfield-related environmental professional services to be
provided under this annual agreement, the additional scope of services may
include the following areas of importance:
• Leaking Petroleum Storage Tank (LPST) site investigation, monitoring,
remediation, and/or closure including necessary field work, data collection
and analysis, reporting, etc;
• Oversight of underground storage tank removal, soil and groundwater
sampling, and report preparation to achieve site closure, etc;
• Phase I Environmental Site Assessments in strict accordance with the All
Appropriate Inquiries Final Rule and ASTM Standard 1527-13 or most
updated version;
• Phase II Environmental Site Assessments including potential impacts to
soil, groundwater, surface water, and air;
• Site remediation, including developing a cleanup strategy under the
appropriate TCEQ program and picking the proper cleanup level for a
particular site, overseeing the cleanup, providing appropriate
documentation to TCEQ during the cleanup process, and seeing the
cleanup through to closure;
• National Environmental Protection Act (NEPA) associated Categorical
Exclusion criteria reports;
• Groundwater water flow issues associated with complex subsurface
characteristics including natural and man-made features. Design, installation
and monitoring of subsurface systems for groundwater flow control,
groundwater treatment, etc;
• Design and construction management of structures, systems, and
components intended to collect and/or prevent pollutants from entering the
municipal separate storm sewer system (MS4);
• Volatile Organic Compound (VOC) impacts to soil and groundwater including
source identification, monitoring/delineation, and active/passive remediation;
• Housing and Urban Development (HUD) compliant Noise Assessments in
accordance with 24 CFR 51, B;
• Housing and Urban Development (HUD) compliant Average Separation
Distance (Explosives) Survey in accordance with 24 CFR 51, B;
4. Miscellaneous:
All other definitions, terms, and conditions of City Secretary Contract number
52535, as amended, shall remain unchanged except as expressly set forth herein.
