This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 54881 ("First
Amendment") is made and entered into by and between the City of Fort Worth, a home-rule municipal
corporation of the State of Texas, acting by and through Fernando Costa, its duly authorized Assistant
City Manager, and Julie Lazarus, an individual, located at 3955 Altura Court, Fort Worth, Texas 76 09.
City has designated the Arts Council of Fort Worth and Tarrant County, Inc., to manage this Agreement
on its behalf. The Contract Manager shall act through its designated Public Art project manager.
WHEREAS,on November 13, 2020,the City and Artist entered into City Secretary Contract No.
54881, an agreement for Final Design of public art for Fire Station#26("Agreement");
WHEREAS, as part of developing the Final Design, Artist requires an increased professional
services allowance to facilitate the completion of engineered drawings as part of Final Design
Deliverables(see Article 2.4.a.vi.); and
WHEREAS, it is the collective desire of both City and Artist to increase the total con act
amount and to amend the payment schedule to reflect the cost to complete engineering for Final Desig a.
NOW,THEREFORE, City and Artist, for and in consideration of the covenants and agreem nts
hereinafter set forth,the sufficiency of which is hereby acknowledged,agree as follows:
I.
The parties wish to revise Article 3 of the Agreement titled "Compensation and Payment
Schedule" to increase the professional services allowance by $840.89 for a total of$8,840.89, therefore
increasing the total contract amount to $13,278.89. Sections 3.1 and 3.2 are deleted in their entirety and
replaced with the following:
"3.1. Compensation.
Total compensation to Artist under the Agreement shall be in an amount of up to THIRT EN
THOUSAND TWO HUNDRED SEVENTY-EIGHT DOLLARS AND EIGHTY-NINE CE TS

($13,278.89), which shall constitute full compensation for any and all costs associated with his
Agreement, including, but not limited to, Artist's fee of$4,438.00, travel, engineering, material san ple
mock ups and consulting fees and services performed and materials furnished by Artist under his
Agreement.
3.2. Payment Schedule.
City agrees to pay Artist in the following installments set forth below, each installmein to
represent full and final, non-refundable payment for all services and materials provided prior to
the due date thereof:
a. ONE THOUSAND DOLLARS AND NO CENTS ($1,000.00) upon execution of his
Agreement.
b. ONE THOUSAND DOLLARS AND NO CENTS ($1,000.00) within thirty (30) calendar days
after Artist submits the Final Design Deliverables as required under Article 2.4 of this
Agreement.
C. ONE THOUSAND DOLLARS AND NO CENTS ($1,000.00) within thirty (30) calendar days
after Artist makes a presentation of the Final Design to the FWAC, the Project Core Team, and
other Project Stakeholders.
d. ONE THOUSAND, FOUR HUNDRED THIRTY-EIGHT DOLLARS AND NO CENTS
($1,438.00) within thirty (30) days after the City notifies the Artist of its approval of the F nal
Design.
e. City will provide an allowance of up to EIGHT THOUSAND, EIGHT HUNDRED FORTY
DOLLARS AND EIGHTY-NINE CENTS ($8,840.89) for engineering, material sample mock-
ups, professional services, and conservator or other consulting fees as necessary. Such payment
shall be made for actual services rendered only and upon receipt of an invoice from Artist with
the original invoice(a retainer fee of up to 50%is allowed)for such services attached.
II.
Funds previously paid to Artist prior to this First Amendment shall apply towards the lotal
compensation paid to Artist.
M.
All other terms, provisions, conditions, covenants and recitals of said Agreement not expressly
amended herein shall remain in full force and effect.
