AMENDMENT No. 4
TO CITY SECRETARY CONTRACT No. 49485
WHEREAS, the City of Fort Worth (CITY) and Neel-Schaffer, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 49485, (the
CONTRACT) which was authorized on the 1st day of August, 2017 in the
amount of $ 458,204.00; and
WHEREAS, the CONTRACT was subsequently revised by Amendment No.1
in the amount of $14,980.00 administratively authorized on May 30, 2018
and Amendment No. 2 in the amount of $58,341.00 administratively
authorized on December 18, 2018 and Amendment No.3 in the amount of
$35,400.00 authorized on May 18th,2021 (M&C 21-0352) ; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Churchill Road Water and Sanitary Sewer Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 4 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through
their duly authorized representatives, enter into the following
agreement, which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $31,254. 00 (Fund 56017- (Water:
$12,096. 00; Sewer: $19,158. 00)) .
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $598,179. 00.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Reference: Churchill Road Water and Sanitary Sewer Improvements Contract Amendment 4 for
Additional Services,CPN 100888,CSC 49485
Dear Lawrence:
Neel-Schaffer, Inc. offers additional Professional Engineering Services for this project. These additional
services were requested by the City of Fort Worth to address the ongoing requests from the Tarrant
Regional Water District (writing letters; marking easements; attending additional meetings; making four
submittals so far; and one redesign of the 8"and 24"water lines,the 8"sewer line and the sewer services
near the levee),the challenges related to the Contractor's extended schedule (failing tests, correcting the
widening of Churchill Road which gives the impression of requiring retaining walls and in general the
greater than normal involvement during construction).
Neel-Schaffer, Inc. proposes to increase the contract amount by$31,254.00 for these additional services.
All additional services will be performed in accordance with the original contract dated August 9,2017.
