WfIEREAS, -es L.P. (Devel ►per) entered into Community
Facility Agreement,,City Secretary Contract No..43455 wherein Developer is to make certain improvements to
Weatherby Station an addition within the City; and
"EREAS, it has: become necessary to execute Amendment No I to the CFA to reflect additional off-site
sanitary sewer construction at an estimated cost of$,326,813.00 and as more fully described on Attachment No. 1.
NOW THEREFOREI, City and Developer, acting herein by and through their duly authorized representatives,
enter into the following agreement, which arnends the CFA:
