AMENDMENT No. 1
TO CITY SECRETARY CONTRACT No. 52494
WHEREAS, the City of Fort Worth (CITY) and James DeOtte Engineering,
Inc. , (ENGINEER) made and entered into City Secretary Contract No. 52494,
(the CONTRACT) which was authorized by M&C C-29140 on the 41-h day of June,
2019 in the amount of $ 728, 560 . 00; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Greenfield Acres Storm Drain Improvements, CPN 102975; and
WHEREAS, it has become necessary to execute Amendment No. 1 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in proposal attached hereto and
incorporated herein. The cost to City for the additional design services
to be performed by Engineer totals $167,239. 00. (See Attached Funding
Breakdown Sheet, Page -4-)
2 .
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $895, 799. 00.
3 .
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.
EXECUTED and EFFECTIVE as of the date subscribed by the City' s
designated Assistant City Manager.

Mr. Wellbaum,
Due to additional services that are outside the scope of the existing contracted
agreements that have been requested by the City to be performed as part of the
referenced project, James DeOtte Engineering, Inc. (JDEI) will perform the work outlined
in the following:
Additional services shall include the re-design of approximately 5,000 LF of storm drain
improvements to lower the drainage system for the potential future construction of
added curb and gutter roadways and approximately 3,500 LF of sanitary sewer
improvements that would be in conflict with the re-designed storm drain. These
improvements will be along:
1. Greenfield Road between Cindy Lane to the east dead end,
2. North Ridge Road between Lea Crest Lane and Tee Head Drive, and
3. Tee Head Drive between Greenfield Road and North Ridge Road.
The specific tasks to be accomplished with this Amendment are outlined within the
attached Level of Effort spreadsheet.
JDEI anticipates the fees listed above for the various elements of the project to be a not
to exceed amount of $167,239.00. All costs, associated with the identified scope of work,
will be lump sum for the scope provided and will be billed as a percentage of completed
work as determined by JDEI.
This scope of work assumes any services not specifically listed as part of this contract will
be treated as an additional service. The owner will be notified before any additional
services are performed.

RECOMMENDATION:
It is recommended that the City Council authorize execution of Amendment Number 1 to City Secretary Contract Number 52494, a professional
services agreement with James DeOtte Engineering, Inc., to increase the contract amount by$167,239.00 for a revised contract amount of
$895,799.00 for the Greenfield Acres Storm Drain Improvements project(City Project No. 102975).
DISCUSSION:
Approval of this Mayor and Council Communication(M&C)authorizes execution of Amendment Number 1 to City Secretary Contract Number
52494, a professional services agreement with James DeOtte Engineering, Inc.,to increase the contract amount by$167,239.00 for a revised
contract amount of$895,799.00 for the Greenfield Acres Storm Drain Improvements project.
Amendment No. 1 includes costs associated with design changes to the construction plans for drainage improvements on North Ridge Road, Tee
Head Drive, and Greenfield Road east of Cindy Lane that are needed to accommodate utility and pavement improvements that may be
implemented in the future under a separate contract. These changes ensure that implementation of the current drainage improvements will not
conflict with future potential utility and pavement improvements. The engineering consultant proposes to complete the additional work for an
amount not to exceed$167,239.00. Staff considers the fee to be fair and reasonable for the additional scope of services.
On June 4, 2019,with Mayor and Council Communication C-29140,the City Council authorized the execution of an agreement with James DeOtte
Engineering, Inc. in the amount of$728,560.00 for the design of the Greenfield Acres Storm Drain Improvements Phase 3 project. To expedite
construction,the project was divided into two parts which added Phase 4. The construction plans being revised through Amendment No. 1 are for
the final phase of the project which will complete storm drain improvements on North Ridge Road, Tee Head Drive, and Greenfield Road east of
Cindy Lane.
Business Diversity: Compliance with the City's Business Equity Ordinance has been achieved by the following method: James DeOtte
Engineering, Inc. agrees to maintain its initial M/WBE commitment of 9%that it made on the original agreement and extend and maintain that
same M/WBE commitment of 9%to the first amendment. Therefore, James DeOtte Engineering, Inc. remains in compliance with the City's
M/WBE Ordinance and attests to its commitment by its signature on the Acceptance of Previous M/WBE Commitment form executed by an
authorized representative of its company.
Funding is budgeted in the TPW Dept Highway&Streets Department's Stormwater Capital Projects Fund for the purpose of funding the
Greenfield Acres Drainage Phase 4 project, as appropriated.
This project is located in COUNCIL DISTRICT 2.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current capital budget, as previously appropriated, in the Stormwater Capital
Projects Fund for the Greenfield Acres Drainage Ph4 project to support the approval of the above recommendation and execution of the
amendment. Prior to an expenditure being incurred,the Transportation&Public Works Department has the responsibility to validate the availability
of funds.
