SECOND (2)AMENDMENT AND FIRST(1) RENEWAL
TO CITY OF FORT WORTH CONTRACT 55697
BETWEEN THE CITY OF FORT WORTH AND SEF BUILDERS INC.
This Second Amendment and First Renewal Agreement("Second Amendment")is
entered into by and between the City of Fort Worth (hereafter "Buyer"), a home rule
municipality, with its principal place of business at 200 Texas Street, Fort Worth, Texas, and
SEF Builders, Inc. ("Contractor"), Buyer and Contractor may be referred to individually as a
Party and collectively as the Parties.
RECITALS
WHEREAS,on or about May 10, 2021, the Parties entered into City Secretary Contract
55697 for Contractor to build weather resistant play yard covers at the animal care and control. ("
Original Agreement");
WHEREAS, the Original Agreement was first amended ("First Amendment") on or
about October 26, 2021 to increase the total compensation;
WHEREAS, the Section 2 of the Original Agreement had initial term from May 10,
2021 to May 9, 2022,but did not provide for any renewal terms.
WHEREAS, the Exhibit C of the Original Agreement, Section 8.2 of the RFP No. 21-
0072, provided that the term of the Original Agreement will be an initial one (1) year term, with
four one-year options to renew at the option of the City,upon the same terms and conditions, and
subject to funding by the City;
WHEREAS, the Parties agree to amend the Original Agreement to permit the Original
Agreement be renewed for four one-year options at the option of the City, as originally stated in
Exhibit C of the Original Agreement; and
WHEREAS, the Parties agree to renew the Original Agreement to a first renewal term
beginning on May 10, 2022 to May 9, 2023.
NOW, THEREFORE, the Parties, acting herein by the through their duly authorized
representatives, enter into the following agreement:
I.
RENEWAL OF AGREEMENT
1. The Original Agreement, as amended herein, is hereby renewed and extended for a Renewal
Term beginning on May 10, 2022 and ending on May 9, 2023.

AMENDMENTS
1. Section 2 of the Original agreement is hereby amended by added the following
language to the last sentence of the section.
City will have the option, in its sole discretion, to renew this Agreement under the
same terms and conditions, for up to four(4) one-year renewal option(s) (each a"renewal
Term")
III.
ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Agreement which are not expressly amended herein shall
remain in full force and effect.
IV.
ELECTRONIC SIGNATURE
This Amendment and Extension may be executed in multiple counterparts, each of
which shall be an original and all of which shall constitute one and the same instrument.
A facsimile copy or computer image, such as a PDF or tiff image, or a signature, shall be
treated as and shall have the same effect as anoriginal.
