HomeMy WebLinkAboutContract 42503-R1 wit 4 CITY ARY L4M CONTRACT NO& CITY OF FORT WORTH FIRST RENEWAL OF AGREEMENT WHEREAS, this FIRST RENEWAL AGREEMENT is between the City of Fort Worth., ("CITY"),and James DeOtte Engineering,Inc.,authorized to do business in Texas,("ENGINEER"),, which renews the ORIGINAL AGREEMENT (City Secretary #42503), said ORIGINAL AGREENffiNT and RENEWAL approved by M&C C-25226 (10-18-11), for the PROJECT generally described as:Water and Sewer Design Services,Contract 201 L and WHEREAS,this RENEWAL AGREEMENT was authorized by the City Council on(6_ 5--12)Via M&C C-25637 NOW,THEREFORE,it is agreed by the CITY and ENGINEER as follows: Article I The Scope of Services as set forth in the ORIGINAL AGREEMENT has not changed. Article H The ENG INEER's compensation, as set forth in the ORIGINAL AGREEMENT, shall be increased to an amount not to exceed $150,000.00 and total agreement amount will not exceed$300,000.00. Article III Except as otherwise noted,there are no changes to the Terms of Payment. Article IV Except as otherwise noted,there are no changes to the Obligations of the Engineer. Article V Except as otherwise noted,there are no changes to the Obligations of the City. Article VI Except as otherwise noted,there are no changes to the General Legal Provisions. WORTH, TX First Renewal of Agreement Page Z of Z JAMES DEOT E ENGINEERING,INC. 1V1CK.L. - �.0 L111Cr11 t1 �i1L1C1 Page 1 of 2 CRY of Fort Worth, Texas Mayor an ounce l Co unication COUNCIL.ACTION: Approved on 6/5/2012 DATE: Tuesday, June 05, 2012 REFERENCE NO.: **C-25637 LOG NAME: 60DESIGN-DENTE SUBJECT: Authorize Execution of the First Renewal with James DeOtte Engineering, Inc., in the Amount of $1 50,000.00 to City Secretary Contract No. 42503 for Water and Sewer Design Services, Contract 2011, Thereby Increasing the Contract Amount to$300,000.00 (ALL COUNCIL DISTRICTS) RECOMMENDATION: It is recommended that the City Council authorize the execution of the first renewal in the amount of $150,000.00 to City Secretary Contract No. 42503 with James DeOtte Engineering, Inc., thereby increasing the contract amount to $300,000.00. DISCUSSION: On October 18, 20111 (M&C C-25225)the City Council authorized an Engineering Agreement in the amount of$150,000.00 with the option for two renewals with James DeOtte Engineering, Inc., for Water and Sewer Design Services, Contract 2011. At this time, it is necessary to appropriate funds for the first renewal of the Agreement in the amount of $1 50,000.00 in order to provide the funds needed for future anticipated work. The Water Department has a need for general engineering design assisting with in house design projects such as water and/or sanitary sewer main replacement, relocation repair and analysis. The Engineer may also provide design for emergency situations, traffic control, erosion control, slope stabilization and other professional engineering or construction services. As engineering work is warranted, the City will issue individual work orders to the Engineer for which cost determination must be prepared and approved before work begins. Design work for emergencies will be directly invoiced for reasonable costs. James DeOtte Engineering, Inc., is in compliance with the City's M/WBE Ordinance by committing to 15 percent M/WBE participation. The City's goal on this project is 15 percent. In addition to the contract amount, $25,000.00 is required for Staff Project Management. This project is located in ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that funds are available in the current capital budget, as appropriated, of the Water Capital Project Fund and the Sewer Capital Project Fund.
