Rushing Road (COUNCIL DISTRICT 8) RECOMMENDATION: It is recommended that the City Council authorize the execution of a Public Right-of-Way Use Agreement with Texas Midstream Gas Services, L.L.C., granting a license to construct and operate a natural gas gathering pipeline across Joe B. Rushing Road, west of Wichita Street, for a one-time license fee of $5,570.00. DISCUSSION: Texas Midstream Gas Services, L.L.C., is constructing an eight-inch pipeline to connect natural gas wells in Fort Worth. With the exception of the pipeline across Joe B. Rushing Road, the pipeline will be located in private easements. The approximate location of the line is shown on the attached map. The Transportation and Public Works Department has reviewed the proposed pipeline route and has no objections. The pipeline will route through residentially zoned and used property. This application was heard before Gas Drilling Review Committee on December 30, 2010. No citizens appeared to speak on this application. The Public Right-of-Way Use Agreement will give Texas Midstream Gas Services, L.L.C., a license to use 120 feet of that specific public right-of-way for the limited purpose of operating a natural gas pipeline for a period of 25 years. Texas Midstream Gas Services, L.L.C., will pay the City a one-time license fee of $5,570.00 in return for this privilege. The company will be required to provide bonds and insurance in accordance with the City's current standard policies. Because Texas Midstream Gas Services, L.L.C., is not a public utility, as that term is defined in Chapter 28 of the City Code, a franchise governing its operations is not required by the City Charter. This crossing is located in COUNCIL DISTRICT 8.
