FIRST AMENDMENT TO CITY SECRETARY CON TRACT NO. 42,900
AN ARTWORK ACQUISITION9 STORAGE9 DELIVERY, AND INSTALLATION
AGREEMENT BETWEEN THE CITY OF'FIORT WORUT AND CAMERON SCHOEPP
This FIRST AMENDMENT TO CITY SECRETARY CONTRACT NO. 42900 ("First
Amendment") is made and entered into by and between the City of Fort Worth ("City"), a home-rule
municipal corporation, acting by and through its duly authorized Assistant City Manager, and Cameron
Schoepp, an individual, residing at 3308 W. 4t" Street, Fort Worth,Texas.
V�HEREAS,, on February 15, 2012, the City and Artist made and entered into City, Secretary
Contract No.42900 (the "Agreement") and the City designated the Ails Council of Fort Worth and
Tarrant County, Inc. as its Contract Manager-,
WHEREAS, under the Agreement, Artist was to relocate an artwork titled Hats to the Fort
Worth Community Art Center located at 1300 Gendy Street,Fort Worth, Texas 76107,
W11ER.EAS, the Site was reconu-nended by Cultural District stakeholders through a
comprehensive review process';
EREAS, the original installation schedule was to include fabricati.on, delivery, and
installation of the Artwork,-
WHEREAS, to facilitate the irlstallation, an existing monument marker identifying the Fort
Worth Community Arts Center must be removed, the site remediated, and new sign ge fabricated; and
WHEREAS, it is the desire of Artist and City to amend the Artist's compensation to include
expenses related to the added scope of work.
NOW, THEREFORE,City and Artist, in consideration of the mutual covenants and agreements
contained herein, do mutually covenant and agree that the Contract is amended as follows-.

The Parties wish to amend Article 4.,5 "Delivery and I-nstallation," to increase the Artist's scope
of work by requiring the Artist to remove, an existing monument marker identifying the Fort Worth
Con unity Arts Center, remediating the Site, and fabricating new si gnage for the Site. Article 4.5 is
amended to add the following subsection:
X49, To facilitate the installation of the Artwork at the Site, the Artist shall remove the
existing monument marker identifying the Fort Worth Conununity Arts Center, remediate the
Site, and fabricate new signage for the Site.
The parties wish to amend Article 5.1 - "Compensation," of the Contract to increase the total
compensation to the Artist to reflect the increase in costs associated with Installing the Artwork at the
Site. Article 5.1 is amended to read as follows.-

"City shall pay Artist TWENTY-SEVEN THOUSAND FOUR IJUNDRED THREE DOLLARS
AND N'O CENTS ($27,40.3 0,0) for all costs associated with the services to be performed and
materials to be furnished by Artist under this Agreement, including, but not limited to, design,
storage, fabrication, transportation, delivery, installation, insurance, incidental costs, and any
other costs associated with this Agreement, excluding the cost to acquire the Artwork stated in
Article 2. City will pay Artist this amount within thirty-five (315), days after F'inal Acceptance
and receipt by City of such documentation it may require concerning payment of supplies and
services rendered to Artist (see Article 4.7'). Payment by the City shall represent full and final,
non-refundable payment for all services acid material, provided prior to the due date thereof"
fil.
Funds previously paid to the Artist prior to this First Amendment shall apply toward the total
compensation paid to the Artist.
IV.
All ten-ns and conditions of the Agreement that are not expressly amended pursuant to this First
Amendment shall remain in full, force and effect.
V.
All ten-ns in this First Amendment that are capitalized but not defined shall have the meanings
assigned to them in the Agreement.
