FIRST AMENDMENT TO
FORT WORTH CITY SECRETARY CONTRACT NO. 55584
BETWEEN CITY OF FORT WORTH
AND PRESBYTERIAN NIGHT SHELTER OF TARRANT COUNTY,UPSPIRE
PROGRAM
This First Amendment to Fort Worth City Secretary Contract No. 55584 ("First
Amendment") is made between the City of Fort Worth ("Fort Worth"), a municipal corporation
and Presbyterian Night Shelter of Tarrant County, Upspire Program, a Non-Profit organization
("Contractor"). City and Contractor shall be referred to individually as a Party and collectively as
the Parties.
WHEREAS, Fort Worth and Contractor entered into an Agreement identified as Fort
Worth City Secretary Contract No. 55584 beginning on or about April 16,2021 (the"Agreement")
for Contractor to provide mowing services to the City; and
WHEREAS, the Parties renewed the Agreement on or about March 08, 2022 for a first
renewal term ("First Renewal");
WHEREAS,the Contractor has requested a price increase on the services provided under
the Agreement due to the escalating rates of fuel and labor costs; and
WHEREAS, it is the collective desire of the Parties to amend the Agreement to replace
the Exhibit B with the Exhibit B attached to this First Amendment.
NOW THEREFORE, known by all these present, Fort Worth and Contractor, acting
herein by the through their duly authorized representatives, agree to the following terms, which
amend the Agreement as follows:
I.
AMENDMENTS
1. The Agreement is hereby amended by deleting Exhibit B of the Agreement and
replacing it with the Exhibit B attached to this First Amendment.
II.
ALL OTHER TERMS SHALL REMAIN THE SAME
All other terms, provisions, conditions, covenants and recitals of the Agreement not
expressly amended herein shall remain in full force and effect.
III.
ELECTRONIC SIGNATURE
This Amendment may be executed in multiple counterparts, each of which shall be
an original and all of which shall constitute one and the same instrument. A facsimile copy

or computer image, such as a PDF or tiff image, or a signature, shall be treated as and shall
have the same effect as anoriginal.
Executed effective as of the date signed by the Assistant City Manager below.
