HomeMy WebLinkAboutContract 50692-A6 AMENDMENT NO. 6 TO AGREEMENT STANDARD AGREEMENT FOR PROFESSIONAL SERVICES FIRE STATION 43 STATE OF TEXAS CITY SECRETARY CONTRACT NO. 50692-A6 COUNTY OF TARRANT WHEREAS, The City of Fort Worth and RPGA Design Group Inc., (Consultant) made and entered into City Secretary Contract No. 50692 (The Contract) which was authorized by the City Council by M&C C-28651 , the 3rd day of April, 2018, for Fire Station 43 + Utility Extensions, Linkmeadow Drive & Interstate Highway 30 / Fort Worth, Texas-land WHEREAS, further amendment is necessary to reimburse the Consultant as part of the design services agreement for additional design services for FS #43 — Additional site adaption services. NOW THEREFORE, City and Consultant, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1 . Article I — Scope of Services, Paragraph (3) shall be added to read as follows: (3) Provide additional professional services for the Building Code adaptation services. The cost of this additional service is $11 ,250.00 plus $0.00 in reimbursable expenses. The scope of services is described more fully in RPGA Design Group, Inc. Letter dated June 2, 2022, subject: "Fire Station #43, Walsh Ranch Site / Fort Worth, Texas, Amendment #6 — City of Fort Worth adoption of 2021 International Building Code (IBC)". 2. Article II — Compensation, first paragraph, is amended as follows: "Consultant shall be compensated in accordance with the Fee Schedule shown in Attachment "A". Payment shall be considered full compensation for all labor, materials, supplies, and equipment necessary to complete the services described in Attachment "A". However the total fee paid by the City shall not exceed a total of $560,604.97 unless the City and the Consultant mutually agree upon a fee amount for additional services and amend this Agreement accordingly." June 2, 2022 Ronald Clements, AIA Property Management Department City of Fort Worth 401 West 13th Street Fort Worth, Texas 76102 RE: Fire Station #43 Walsh Ranch Site/ Fort Worth, Texas Amendment#6—City of Fort Worth adoption of 2021 International Building Code (IBC) Mr. Clements, In order that we might reach a clear understanding, please accept this as our proposal for additional Architectural/engineering services as required to review and revise the current design of FS#43 to confirm compliance with the 2021 IBC which has been recently adopted by the City of Fort Worth. We submit the following for your consideration and approval. I. Project Description A. General Description: From our initial assessment, the City's adoption of the 2021 IBC triggers some changes to the analysis of building loads and the tornado shelter. Further research will be required to determine if the 2021 IBC triggers changes to egress requirements and/or occupancy separations, as well as other structural, mechanical/electrical, and building design changes. B. Changes to the construction documents will be limited to any updates required to comply with the 2021 IBC. However, we currently do not anticipate any significant changes to the construction documents in having to complying with any changes within the 2021 IBC. II. Compensation: A. Based on our understanding of the scope of services to be performed for conformance to the 2021 IBC, our additional services fees are as stated below. If during the analysis of the 2021 IBC it is determined that significant project changes are required, fees may be subject to revision. Fees as quoted are good for a period of (90) ninety days from the date of this proposal. Proposed Architectural/Engineering Additional Services Fees for adoption of the 2021 IBC for Fire Station #43 Owner agrees to pay the Architect for additional services rendered under this agreement. The Architect's fee for Additional Services shall be a flat fee based on the following understanding.
