HomeMy WebLinkAboutContract 54951-A2 CSC No. 54951-A2 SECOND AMENDMENT TO CITY SECRETARY CONTRACT NO. 54951 This Amendment("Amendment")is made and entered into by and between the City of Fort Worth("City") and United Community Centers, Inc. ("Agency") by and through their duly authorized agents. City and Agency may be referred to individually as "Party" and jointly as "Parties." WHEREAS, the City and Agency made and entered into City Secretary Contract No. 54951 ("Contract") on December 1, 2020; WHEREAS, City receives grant monies from the United States Department of Housing and Urban Development ("HUD") through the Community Development Block Grant Program ("CDBG"), Program No. B-20-MC-48-0010, Catalog of Federal Domestic Assistance No. 14.218; WHEREAS, the CDBG regulations and related HUD guidance publications establish all requirements for the CDBG funds; WHEREAS, City believes that the requested amendment will help Agency meet the program's goals and further the interests of both Agency and City; WHEREAS, City approved M&C 22-0450 on June 14, 2022 and whereby the revised Exhibit "A"- Program Summary previously included in Amendment 1 of the Agreement (CSC. 54951-A1)will now reflect an effective date of June 14, 2022 in accordance with the M&C; and WHEREAS,it is the mutual desire of City and Agency to amend the Contract to complete the Program and meet Contract objectives. NOW,THEREFORE, City and Agency hereby agree to amend the Contract as follows: I. EXHIBIT" A" PROGRAM SUMMARY attached to the Contract is hereby amended and replaced in its entirety with EXHIBIT " A" Revised June 2022, attached hereto. II. (CDBG) UNITED COMMUNITY CENTERS,INC.—(UCC) EXHIBIT "A" Educational Enrichment Program PROGRAM SUMMARY PROGRAM SUMMARY (CDBG) October 1,2020 (previous effective date) June 14,2022 (new effective date) to September $165,555.00 30, 2022 PERIOD AMOUNT Capitalized terms not defined herein shall have meanings assigned them in the Contract. PROGRAM: The Educational Enrichment program will provide a child care literacy program. The Program assist children pre-k to 13 years of age with reading,writing, comprehension and is designed to increase literacy skills, United Community Centers, Inc. also provides a licensed child care after-school program during the regular school year and full-day during the summer. The after-school program classes are aligned with the Fort Worth ISD Calendar and provide a full-day summer program. The Summer program is ten (10) consecutive weeks from early June to mid-August. UCC serves clients all day through October 08, 2020. Due to the COVID-19 Pandemic UCC will follow social distancing guidelines and intends to resume normal program operations when it is considered safe to do so. UCC is also reserving the right to possibly extend all day services if families continue to need all day services. CDBG Funds will be used to pay for a percentage of salaries for employees. The percentage of any program employee's salary will not exceed the percentage of Fort Worth clients participating in the Program and shall be cost allocated in accordance with the amount applicable to the CDBG funded Program. Agency's office is located at 3900 Meadowbrook Drive, Ste 122, Fort Worth, TX 76103. After-School Program Monday through Friday, 2:00 p.m. to 6:00 p.m. CDBG 51%PSA CONTRACT 2020-2021 —EXHIBIT"A"—PROGRAM SUMMARY Page 1 UNITED COMMUNITY CENTERS,INC.(UCC)—Amendment 2 Full-day Summer Program 7:00 a.m. to 6:00 p.m. for summer and on school waiver days/holidays. Services will be provided at the following locations: United Community Centers, Inc.- Wesley 3600 N. Crump St., Fort Worth, Texas 76106 United Community Center s, Inc - Bethlehem 951 Evans Avenue, Fort Worth, Texas 76104 United Community Centers, Inc. - Poly 3100 Avenue I, Fort Worth, Texas 76105 Agency is a Fort Worth Agency which means at least 90% of clients served by the Program are Fort Worth residents. Agency will submit documentation which verifies that at least 51% of all clients served by the Program, whether Fort Worth residents or not, are Income Eligible Clients with current household incomes at or below 80% of AMI. PROGRAM GOALS: Minimum Fort Worth Agency Program Performance Outcome: At least 51% of all Program clients must be Income Eligible Clients. Agency must furnish City a Certification of Income Statement for all clients served. For example, if the Program serves 1,000 clients, 510 must be Income Eligible Clients. In this example,Agency would be required to furnish City 1,000 Certification of Income Statements that prove at least 510 of the clients served by the Program are Income Eligible Clients. When determining the number of clients which constitutes 51%, HUD regulations require that partial numbers must be rounded up. Authorize substantial amendment to the City of Fort Worth's 2020-2021 Action Plan to reallocate a total of$65,555.00 in unprogrammed Community Development Block Grant Funds, including $1,414.28 from Housing Channel (City Secretary Contract Number 54967), $30,333.90 from Goodwill (City Secretary Contract Number 54903), $5,259.28 from Guardianship Services (City Secretary Contract Number 54928), $16,252.22 from Ladder Alliance(City Secretary Contract Number 54949), $0.01 from Presbyterian Night Shelter (City Secretary Contract Number 54936), and$12,294.00 from AB Christian Learning Center-Freedom School (City Secretary Contract Number 54947), including $1.31 of unprogrammed funds to the contract with United Community Centers, Inc. (City Secretary Contract Number 54951)contingent upon successful completion of the federal public comment period; and 2. Authorize the City Manager or his designee to further amend the agreement if necessary to achieve program goals and meet Housing and Urban Development expenditure deadlines, provided the amendment is within the scope of the program and in compliance with applicable City policies, laws and regulations. DISCUSSION: The City of Fort Worth City Council approved Mayor and Council Communication (M&C)20-0497, the City of Fort Worth's 2020-2021 Annual Action Plan, on August 4, 2020. The 2020-2021 Annual Action Plan summarizes the major housing and community development activities and proposed expenditures for the program year beginning on October 1, 2020 and ending September 30, 2021 for the use of federal grant funds totaling$12,793,159.00 from the United States Department of Housing and Urban Development(HUD)from the Community Development Block Grant(CDBG), HOME Investment Partnerships Program(HOME), Emergency Solutions Grant(ESG), and Housing Opportunities for Persons with human immunodeficiency virus, acquired immunodeficiency syndrome (HIV/AIDS) (HOPWA)grant programs. The primary purposes of these programs is to benefit low-and-moderate-income persons in Fort Worth, homeless persons, and low-and-moderate-income persons with HIV/AIDS. Six of the agencies receiving funding under the 2020-2021 Annual Action Plan did not expend their funding allocation within the federal program contract period ending September 30, 2021. As a result, there is a total of$65,555.00 in unprogrammed Community Development Block Grant Funds. The Neighborhood Services Department recommends approval to direct these funds to United Community Centers, Inc. (hereafter, UCC) to use for educational enrichment programming. Social Services for school-age children continues to be an urgent need in responding to the Coronavirus pandemic. Directing these funds to UCC will provide vulnerable youth with services to address negative educational or developmental impacts from the pandemic. The Agreement with UCC was extended until September 30, 2022 to ensure that there is no disruption in services and that program goals are met. A public notice authorizing this reallocation of funds was published in the Fort Worth Star-Telegram on Sunday, May 15, 2022, with the five-day comment period being completed on May 20, 2022. The notice was published after the executed amendment with UCC, dated February 23, 2022 (CSC No. 54951-A1). However, no funds have yet been reallocated or expended. Moreover, after approval of this M&C, CSC No. 54951-A1 will be amended so that it reflects an effective date of June 14, 2022. FISCAL INFORMATION/CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendations and reallocation of funds, funds are available in the current operating budget, as appropriated, in the Grants Operating Federal Fund. The Neighborhood Services Department(and Financial Management Services)will be responsible for the collection and deposit of funds due to the City. Prior to an expenditure being incurred, the Neighborhood Services Department has the responsibility to validate the availability of funds. This is a reimbursement grant.
