WHEREAS, The City of Fort Worth and HKS, Inc., (Consultant) made and entered into
City Secretary Contract No. 54952 (The Contract) which was administratively executed,
the 1 st day of December, 2020, for the design of the new Far Southwest Branch Library,-
and Amendment No. 1 was approved by M&C 21-0426 on June 22, 2021 for Phase II
which included the completion of Schematic Design, Design Development, Construction
Documents, Bidding, and Construction Administration services. The Total Cost of the
additional service was $641 ,004.00 plus $8,500.00 in reimbursable expenses.
WHEREAS, further amendment is necessary to reimburse the Consultant as part of the
design services agreement for additional design services for Public Art Coordination
with the Artist, Area C Music.
NOW THEREFORE, City and Consultant, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I — Scope of Services, Paragraph (3) shall be added to read as follows:
(3) Provide additional design services for the Public Art Coordination with the Artist
for the Far Southwest Branch Library. The cost of this additional service is
$5,180.00 plus $800.00 in reimbursable expenses. The scope of services is
described more fully in HKS, Inc. Letter dated May 12, 2022 subject: "City of Fort
Worth Far Southwest Library, HKS Project Number 23782.000", Additional
Service No.1 — Public Art Assistance.

Article II — Compensation, first paragraph, is amended as follows:
"Consultant shall be compensated in accordance with the Fee Schedule shown
in Attachment "B". Payment shall be considered full compensation for all labor,
materials, supplies, and equipment necessary to complete the services
described in Attachment "B". However, the total fee paid by the City shall not
exceed a total of $754,435.00 unless the City and the Consultant mutually agree
upon a fee amount for additional services and amend this Agreement
accordingly."

The scope of this proposal is as follows:
Re: City of Fort Worth Far Southwest Library • Limited review of Public Art piece as designed by Area C Music.The work
HKS Project No.23782.000 provided by the Artist is titled "Fable"and will sit to the westerly side of high
Additional Service No.1 -Public Art pop-up zone in the Library.
Assistance
Scope of Services
HKS will provide architectural review of the art piece proposed regarding placement
with the work of our other consultants. HKS will retain the services of the following
consultants with their disciplines shown:
• DFW Engineering -MEP/FP and low voltage engineering
• JQ Engineering -Structural
Design team has and will continue to review Public Art"Fable"as presented by Area C
Music.
HKS scope includes review and providing comment back to the Artist in regard to
items that we might see as problematic with current layout or systems.
The Artist provides his own engineering group specific to the art piece itself.Our MEP
engineer will provide data/power box at the base of the Public Art as this is finalized.
Specific letters from our structural engineer and MEP engineer are included with this
letter.
Fee and Payments
Compensation to HKS and its consultants described shall be as follows: lump sum fee
