HomeMy WebLinkAboutContract 55969-A1 CSC No. 55969-Al AMENDMENT No. 1 TO CITY SECRETARY CONTRACT No. 55969 WHEREAS, the City of Fort Worth (CITY) and Neel-Schaffer, Inc. , (ENGINEER) made and entered into City Secretary Contract No. 55969, (the CONTRACT) which was authorized by M&C 21-0406 on the 22nd day of June, 2021 in the amount of $ 285, 711 . 00; and WHEREAS, the CONTRACT involves engineering services for the following project: 2022 Bond Year 1, Contract 2, CPN 102927; and WHEREAS, it has become necessary to execute Amendment No. 1 to the CONTRACT to include an increased scope of work and revised fee. NOW THEREFORE, CITY and ENGINEER, acting herein by and through their duly authorized representatives, enter into the following agreement, which amends the CONTRACT: 1 . Article I of the CONTRACT is amended to include the additional engineering services specified in proposal attached hereto and incorporated herein. The cost to City for the additional design services to be performed by Engineer totals $12,110. 59. (See Attached Funding Breakdown Sheet, Page -4-) 2 . Article II of the CONTRACT is amended to provide for an increase in the fee to be paid to Engineer for all work and services performed under the Contract, as amended, so that the total fee paid by the City for all work and services shall be an amount of $297,821 .59. 3 . All other provisions of the Contract, which are not expressly amended herein, shall remain in full force and effect. After that, the design will require approximately another six weeks. Neel-Schaffer, Inc. proposes to use the $30,000 contingency for additional services to fund most of the$33,678 of work for water. See attached Level of Effort for backup. Neel-Schaffer, Inc. proposes to use the $20,000 contingency for additional services to fund the $6,530 of work for paving. See attached Level of Effort for backup. Neel-Schaffer, Inc. proposes to request the remainder of the $8,432.59 drainage budget to fund the majority of the needed $15,235 shown in the attached Level of Effort. The remaining $6,802.41 will be funded via TPW contingency for additional services. A small contract amendment is required for the work as it exceeds the funding already in the contract. The water work exceeds the water contingency by $3,678 and the drainage work exceeds the existing funding by $8,432.59. All paving work and additional drainage work is covered by the TPW additional services contingency. Therefore, a contract amendment in the amount of$12,110.59 is required.
