CITY OF FORT WORTH
FIRST RENEWAL OF AGREEMENT
WHEREAS, this First Renewal of Agreement is between the City of Fort Worth,
("CITY"),and Shield Engineering Group,PLLC. ("ENGINEER");and
WHEREAS, CITY and ENGINEER desire to renew the Original Agreement (City
Secretary#56396;M&C 21-0380)for the Project generally described as:
Water and Sanitary Sewer Design Services Contract 2020;and
WHEREAS, funding for this renewal is available as appropriated by M&C 22-0413
(June 14,2022).
NOW,THEREFORE, it is agreed by the CITY and ENGINEER as follows:
Article I
The Original Agreement is hereby renewed for another term as described therein.
Article II
The ENGINEER's compensation for this renewal shall remain $270,000.00, as
specified in the Original Agreement.

Services Contract 2020 and to Effect a Portion of Water's Contribution to the Fiscal Years 2022-2026
Capital Improvement Program
RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated
receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$300,000.00,
transferred from available funds within the Water& Sewer Fund, for the purpose of funding the Water and
Sanitary Sewer Design Services Contract project(City Project No. 103324)and to effect a portion of
Water's Contribution to the Fiscal Years 2022-2026 Capital Improvements Program.
DISCUSSION:
On June 8, 2021, Mayor and Council Communication (M&C 21-0380)the City Council authorized the
execution of an Engineering Agreement in the amount of$270,000.00,with Shield Engineering Group,
PLLC. for Water and Sanitary Sewer Design Services Contract 2020 (City Secretary Contract No. 56396)
and provided for the option of three renewals.
The City and the Consultant desire to exercise the first renewal of the contract in the same amount and
with the same terms and conditions.
The Water Department has a need for general engineering design assisting with in-house design projects
such as water and/or sanitary sewer main replacement, relocations, repairs and analysis.The Engineer
may also provide design for emergency situations including traffic control, erosion control, slope
stabilization and other professional engineering or construction services.As engineering work is
warranted, the City will issue individual work orders to the Engineer for which a cost determination will be
prepared and approved before work begins.
In addition to the contract cost, $30,000.00 (Water: $15,000.00; Sewer:$15,000.00) is required for project
management and material testing.
It is the practice of the Water Department to appropriate its CIP plan throughout the fiscal year as projects
commence, additional funding needs are identified, and to comply with bond covenants.The actions in
the M&C will appropriate funds in support of the Water's portion of the City of Fort Worth's Fiscal Years
2022-2026 Capital Improvement Program, as follows:

Funding is budgeted in the Transfer to Water/Sewer account of the Water operating budget for the
purpose of funding the Design Services Contract 2020 project within the Water&Sewer Capital Projects
Fund.
This project will have no impact on the Water Department's operating budget when completed.

Business Equity: Shield Engineering PLLC agrees to maintain its initial M/WBE commitment of 10
percent that it made on the original agreement and extend and maintain that same M/WBE commitment
of 10 percent to this first amendment. 'Therefore Shield Engineering PLLC remains in compliance with the
City's Business Ordinance and attests to its commitment by its signature on the Acceptance of Previous
M/WBE Commitment form executed by an authorized representative of its company.
This project is located in ALL COUNCIL DISTRICTS.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are currently available in the Water& Sewer Fund and upon
approval of the above recommendation and adoption of the attached appropriation ordinance, funds will
be available in the W&S Capital Projects Fund for the Design Services Contract 2020 project. Prior to any
expenditure being incurred, the Water Department has the responsibility to validate the availability of
funds.
