FIRST AMENDMENT
TO
CITY OF FORT WORTH CONTRACT 55009
BETWEEN CITY OF FORT WORTH AND
TEXAS A&M VETERINARY MEDICAL DIAGNOSTIC LABORATORY
This First Amendment Agreement (the "Agreement") is entered into by and
between the City of Fort Worth (hereafter"City"), a Texas home rule municipality, with its
principal place of business at 200 Texas Street,Fort Worth, Texas, and Texas A&M Veterinary
Medical Diagnostic Laboratory("Vendor"), a corporation and acting by and through its duly
authorized representative, Matthew Durham, Assistant Agency Director for Finance and
CFO, each individually referred to as a "party" and collectively referred to as the "parties."
WHEREAS,on January 30,2021,the Parties entered into City Secretary Contract 55009
for the Vendor to provide laboratory specimen testing for deceased animals to the City (the
"Original Agreement");
WHEREAS, on September 1, 2021, the Agreement was renewed a first time to extend
the term until August 31, 2022;
WHEREAS, the Parties agree to increase the total payment made under the Original
Agreement for the current term and all future terms in an annual amount not to exceed One
Hundred Thousand Dollars and No Cents ($100,000.00).
NOW, THEREFORE, the Parties, acting herein by the through their duly authorized
representatives, enter into the following agreement:

AMENDMENTS
1. The Original Agreement is hereby amended by deleting the language, in its
entirety,in Section 3 of the Original Agreement, titled Compensation, and replacing it with the
following language:
3. Compensation. City will pay Vendor in accordance with the provisions of
this Agreement, including Exhibit "B", which is attached hereto and incorporated herein
for all purposes. Total compensation under this Agreement will not exceed One Hundred
Thousand Dollars and No Cents ($100,000.00). Vendor will not perform any
additional services or bill for expenses incurred for City not specified by this Agreement
unless City requests and approves in writing the additional costs for such services. City
will not be liable for any additional expenses of Vendor not specified by this Agreement
unless City first approves such expenses in writing.
2. The Original Agreement is hereby amended by replacing Exhibit B of the Original
Agreement with the Exhibit B attached to this Amendment.

ALL OTHER TERMS SHALL REMAIN THE SAME
All other provisions of the Original Agreement which are not expressly amended herein
shall remain in full force and effect.

ELECTRONIC SIGNATURE
This Amendment and Renewal may be executed in multiple counterparts, each of
which shall be an original and all of which shall constitute one and the same instrument.
A facsimile copy or computer image, such as a PDF or tiff image, or a signature, shall be
treated as and shall have the same effect as anoriginal.

The TVMDL Fee Schedule is a "living document" where new test offerings are added
and unused tests are removed as necessary throughout the year. Additionally, the Fee
Schedule undergoes an annual fee analysis to determine the most accurate price to
perform each test. The revised fees are updated on our website as of 9/1 each fiscal
year.
The previous Exhibit B in the original contract listed 78 pages of "static" tests and
prices that are not/will not be accurate as of 9/1. In lieu of providing an annual listing
for Exhibit B during this contract renewal process, I have added a link below to
TVMDL's published Fee Schedule which lists all the current tests and pricing. Please
refer to this website and the "Download Full Fee Schedule" link on this page for the
most up-to-date information related to all test offerings and pricing.
