HomeMy WebLinkAboutContract 54232-A2 CSC No. 54232-A2 AMENDMENT 2 TO CITY SECRETARY CONTRACT NO. 54232, VENDOR SERVICES AGREEMENT BETWEEN THE CITY OF FORT WORTH AND AUSTIN MCNELLY CARTER This Amendment is made a part of the Agreement between the City of Fort Worth ("City") and AUSTIN MCNELLY CARTER("Vendor"),City Secretary Contract No.54232.The terms and provision of this Amendment shall control to the extent there is a conflict between the terms and conditions of this Amendment and the terms and conditions of the Agreement. WHEREAS, on August 3, 2020, the City and Vendor entered into City Secretary Contract No. 54232 for Vendor to provide sound engineering and support services for the Fort Worth Public Library; and WHEREAS,on July 6,2022,City Secretary Contract No. 54232 was most recently renewed for an additional year and will expire on August 31,2023;and WHEREAS, the Parties now wish to amend the Agreement for the purpose of updating and replacing Exhibit A—Scope of Services;and WHEREAS, the Parties now wish to amend the Agreement for the purpose of updating and replacing Exhibit B—Price Schedule. NOW, THEREFORE, the Parties, acting herein by and through their duly authorized representatives,enter into the following agreement: 1. AMENDMENTS TO AGREEMENT Exhibit A, Scope of Services,is hereby amended and replaced in its entirety with the attached Exhibit A. Exhibit B, Price Schedule,is hereby amended and replaced in its entirety with the attached Exhibit B. 2. ALL OTHER TERMS SHALL REMAIN THE SAME All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. 3. ELECTRONIC SIGNATURE This Amendment may be executed in multiple counterparts, each of which shall be an original and all of which shall constitute one and the same instrument.A facsimile copy or computer image,such as a PDF or tiff image,or a signature,shall be treated as and shall have the same effect as an original. Carter Carter Classic Sound Date: Aug 11, 2022 OFFICIAL RECORD CITY SECRETARY FT.WORTH, TX Page 2 of 4 EXHIBIT A SCOPE OF SERVICES PERFORMANCES City will notify Vendor of upcoming events requiring sound engineering and support services. Vendor shall respond back confirming his ability to perform on that date and time.All performances by Vendor shall be subject to the terms and conditions of this Agreement even though they are being requested through a separate document. Support is needed for new and reoccurring events including but not limited to the Third Thursday Jazz Series,The Fort Worth Symphony Orchestra performances, and The Cliburn performances. The Vendor will not be required to support more than ten(10)performances per term. PERFORMANCE LOCATION Vendor will support events at the Fort Worth Central Library located at 500 W 3rd St,Fort Worth,TX along with other Fort Worth Public Library and City of Fort Worth venues. SUPPORT ACTIVITIES The sound engineer will arrive at least 4 hours before performance time to set up the system and prepare for sound check.The sound engineer will provide support services to the musicians for sound check and throughout the event.The sound engineer will not leave until the concert is completed and the sound system is broken down and stored.
